hey forum I have a unique situation was wondering if anybody ever. So I'm 19 months into my 60 month chapter 13 plan which as I notice I'm only paying on the car and trustee which there was much more a peice of heavy equipment and at least 10 credit cards they is all listed as unsecured. Now however I was thinking do to today's market my vehicle actually have positive equity and was wondering if my fiancé who is not apart of my 13 trade the vehicle if of course the trustee approve wat will happen will they revamp the plan and make me responsible for the unsecured stuff. Thanks
Yes, you would be increasing the dividend you pay to unsecured creditors if you trade in the car early. So I wouldn't do it unless the car is a maintenance nightmare. If you are in a 100% plan, then it doesn't matter. Just get permission from your lawyer and trustee.
I don't think this is a 100 percent plan cuz when I look at break down an balance I only paying car an trustee so I was tryna figure out would they then change it
