So I just paid my lawyer and brought them all the paper work for my chapter 7.He told me they will call me next Tuesday for a questionnaire, my question is what's the timeline for all this.Whats after the Questionnaire? And so on ?
for our joint chap7 in AZ...We had our consultation on 12/9/19, submitted ppwk that included a questionnaire on 1/2--we purposely waited until after the new year for our legal plan to take affect which paid our attorney fees. We filed 1/16, MOC 2/24, and discharged today 5/4!
The date you want more than anything else is the file date. Once its filed and you get that far. Its basically done. As far as everything submitted to the courts was in order.
Timeline?....what's that? To give you the other end of the spectrum....I filed June 2019, DC'd Oct 2019, case still open 217 days post DC.
Going on a full year for a Ch 7 asset case....Even though it was an asset case, i simply bought the assets back from the trustee. There was no seizure of property, auctions, distribution of funds to creditors, etc....The only creditor getting any $ is the IRS for owed taxes.
Currently waiting on trustee to send $20k to the IRS on my behalf for back taxes and then it should be closed.
These latest filings a month ago, sure does make it appear that my case is close to being closed.
- Chapter 7 Final Report-Asset
- Notice to Trustee Regarding Outstanding Fees
- Notice of Chapter 7 Final Report
- Certificate of Service
When it's over, i 'll start my own short story of a thread....It is quite the story.
How's your credit report now ?
Yes the timeline starts at date of filing with court. Your preliminary dealings with your lawyer are on top of/before the filing date. I handed all my paperwork into my lawyer early March but then COVID19 struck and I didn't end up seeing my paperwork filed with the court until last Wed/April 29, as he was swamped with other things going on. Already I have received word from the court my MOC is June 1 (by phone). If all goes well, I would imagine my Ch7 should discharge by early August. So that would be 3 months and change, if so, from file to dispatch.
