FYI, this same item appeared on my Credit Karma this morning. I think it's interesting that everyone impacted by this seems to be a CK user, and it's only been about two weeks since I signed up for the CK service ...

Anyway, I filed a complaint with the CFPB. I'll also file a police report tonight and keep everyone posted on progress. What a scam.

Dont forget the BBB. They pay to have that A+ rating. Dont want to lose it. CK has nothing to do with it.

i need help please.  i got this on my score yesterday.  i do not know who they are and i am in ny.  When i key the company 'midwest recovery systems' in the complaint section, it cannot be found.  

Also, beside bbb, where else should i report so it goes away from my credit report.

 

Any assistance will be greaty appreciated

This exact thing happened to me on Monday.  Popped up on all 3 bureaus, tanking my scores BTW.  I have now disputed it with all 3, filed a complaint with the CFPB, BBB and FTC.  They aren't even licensed to collect debt in my state (I checked).  No letter in the mail, nothing.  Got an alert from Experian this morning that it was deleted (though it hasn't hit MyFico yet so I'm hoping my scores bounce back when all is said and done.  Ridiculous!!!

Starting Scores (9/19): EQ - 474/TU - 528/EX - 502
Current Scores (09/22): EQ - 617- TU - 638/EX - 647

The CA is required to send a dunning notice within 5 days of "first contact", and courts are in agreement that placing an item on your reports is considered "contact". HOWEVER - lack of reciept of a dunning notice on the part of the debtor is not pima facie evidence of a violation of law. What it does do is make your DV timely, as that 30 day clock is based on your reciept of the dunning notice, and not their sending of it (often to an old address). Any collection activity by them after your DV is a clear violation of FDCPA.

 

Attempts to (knowingly) collect on a BK discharged debt is a violation of US bankruptcy law.

They did the same thing to me last week. They wanted me to pay 640 dollars for a payday loan from 2012 and they would delete the account after I made the payment. I have already verified with my bank they said the loan went into and no loan was placed in the account at all. They said probably a paper check was sent to me instead of a direct deposit. I live in NC and I thought payday loans are illegal in my state. I have already disputed with experian. I requested full debt validation and they said they would send it to within 30 days. Then after that if I disagree they would me file a fraud report to get it removed. Would I have any grounds to file a lawsuit against them?

As I started this post. I showed all that i did. It all worked in 4 days and the CRA's were notified by MRS. Everything deleted in 2 hrs after uploading proof no such company existed. I always heard back from the CFPB until I sent the proof of a closed business. They were not licensed in my state, and the company that they had as who they were hired by was a closed business. I have not heard back yet. So the CFPB does forward things to the FTC. This may be the case. And the threaten to sue from my lawyer to them a day earlier put enough heat on them to delete. Follow what I did and you'll be fine. Unless you did use a pay day loan in which I never have.

Just got notice from cct that this account was added for $870 and never received anything. I will be doing the same thing everyone else did today. Of course my scores dropped which sucks because I was hoping for cli for Christmas. Ugh

As an update to everyone after disputing with all 3 bureaus, the CFPB and the BBB, I've had it deleted from all 3 bureaus though for some reason, my Experian score hasn't gone back up yet and the other 2 have so hopefully that will happen soon.  On another note, I FINALLY got approved for a Walmart cc.  Granted, it's only $500 but was hoping to have it for Christmas as cash is tighter this year than last due to a new car bought this year but I finally got it!! Smiley Happy
