Well I had my 341 yesterday afternoon. It was alot different than I imagined it.
From reading different posts on the internet I was expected to be sitting in a hall way for an hour or so and then being walked into a private room with the trustee, my Lawyer and any creditors.
My actual expereince was a lot different.
I was greated at the door of the court building by my laywer (this wasnt planned, we just happened to get there at the same time).After going through security we walked down into the court buildings basement and then I was walked into large room, even though the room wasnt an official court room it was arranged like one. It had the trustee or judge (little confused as they never said who they were) up on a platform behind a table with a podium in front for the debtors, on either side of the podium were conference tables were the clients laywers (including mine) were sitting. Behind the podium and the tables were about 20 rows of seats where we all sat waiting our turn. Each person was called to the podium where there happened to be a microphone attached to it. Everything we said was broadcast through a PA system to the rest of the room and the overflow room at the very rear.
Nothing was private. When I first sat down there was a guy going through a chapter 11. He was there when I walked in and didnt leave for another hour. He seemed to own several franchises (a bunch of little ceasers and Rallys Hamburgers) restaurants. They went over just about everything and I had to sit and listen to it all thinking, "Is he going to go over all my stuff like this as well?"
As I was sitting there a laywer from my credit union shows up, I told them earlier that I was reafirming thier loans (My House and Car) and even thoug I signed the reaffirmation papers and they were in the mail, they wanted them signed before this meeting so he showed up and I had to sign another copy right there in the courtroom.
So when My turn came Both my lawyer and the credit unions lawyer both came to the podium with me.
My questions were pretty simple at this point.
"Do you swear or affirm that what you are about to say is the truth?" " Yes Sir"
"Is your Name DebtZilla?" " yes Sir"
"Have you listed all your assest on the (forgot the name)form?" "Yes Sir"
"Do you own (address)" "Yes sir"
"Is the loan on the property XXXX?" "Yes Sir"
"How much would you say the property is worth?" "I believe its worth XXXX"
"Are you buying XX vehicle?" "Yes Sir"
"Do you own XX vehicle?" "Yes Sir" My lawyer then says "Its covered by exemptions"
"Do you have any investments or stocks?" "I have a 401k"
"Ok, any creditors have any questions?"
Then the Credit union Lawyer steps up and says
"Im XXXX from XXXX credit union and I have questions that were answered via affermation. Thank you"
"Ok any other creditors?" "You are dismissed."
That was it.
Even though It want that bad, I was stressed out by the end of it and my mind was swimming. I took me the rest of the afternoon to calm down LOL. But I am glad its over with.
Now the waiting game.
I'll tell you that I never want to have to do this again.
That sounds fairly similar to my experience. Not fun, but the worst is behind you. Congrats on taking a big step toward getting your life back on track!
My atty is filing my BK7this week and I'm all butterflies and such. Your 341 description has alleviated a bit of that nervousness. Thanks!
Similiar to ours. Alot out in the open while waiting with different clients and attorneys talking not in private. Then in the room with just attorney and trustee and not a lot of inquiries.
Just have everything prepared beforehand.
