Questions about unauthorized inquiries

Im not sure if this is the right board for this question, but since I am just coming out of chapter 7 I have been lurking on this board. If I should have put this somewhere else, please let me know!

 

I am looking for some advice about inquiries I did not authorize. Since I did not reaffirm my vehicle I was worried about the car getting taken before I could get a new one. In January I received a letter from Tidewater saying I could get financing during chapter 7. Stupidly, I called the number and applied (I let my worry about the car get to me!). Anyway, they told me I was "approved" and they would send my app to the dealer they work with and they will contact me to pick out my vehicle and complete the paperwork. Okay, at this point I realized how dumb this was and I should not have done it!

 

An hour later I get a phone call from a dealership 2 hours away saying all I have to do is look online, find the car I want, and they will bring it to me. lol. No thank you. I told him I was not interested and I wanted to wait until my discharge to get good financing. 

I thought this was over with. Was I wrong! That dealership went ahead and ran my credit and then sent my app to 5 different lenders. 

Over the next few days Tidewater sent my "approval" to 2 more dealers, who also ran my credit and sent my app to 3-5 more lenders each!  In the end, I ended up with about 15 inquiries! 

 

I was not happy about this at all. I sent emails and letters to every one of the lenders who pulled my credit and stated this was unauthorized. I also started BBB complaints, but have only done 3 so far. None of them have responded to the emails or the complaints. And, even though this all happened in January, at the end of Feb one of these dealers sent my to app another lender....this time the same lender I have my current car with! I got a letter from them in the mail saying my app was denied for poor history with them. lol. 

 

So, my question is, can I do anything about this???? To me this is fraud....when I called Tidewater I authorized them to pull my credit. They are only one lender! I didnt authorize dealerships or 20 lenders. It doesnt seem right these companies can do this....and just continue to send my app to new lenders when they feel like it. Any advice???

So Tidewater was not a lender but a lead seller and you were targeted because of your bankruptcy filing. Did you sign any paperwork with Tidewater? Sounds like you gave Tidewater permission to have their dealer partner pull your credit. Once it got to the dealer, multiple inquiries were done by them ... but with your authorization ... indirectly.

 

Why anyone would apply for credit DURING THE BANKRUPTCY PROCESS is beyond me. Hard lesson to learn for sure but I don't see anything that you could do about it. Do not apply for any more credit before your discharge.

Ezdriver....no Tidewater is a lender. tidewater motor credit. I called them & they said that should not happen & they send my approval to the dealer (kind of like capital one blank check the way they explained it).
No i never signed anything.....& im pretty angry!

Like I say over and over and over again on these boards... if you think there's a problem with something on your credit report (that you've sent a single CMRRR and MOV for), ALWAYS call an FCRA attorney.  If the problem is real, they'll take your case for free, get the problem fixed, and get you a nice fat check of free money.

 

If the FCRA attorney won't take your case, or wants to charge you; it's not something that can be fixed so you know to stop wasting time fretting over it.
