Reaffirmation denied, but binding? NFCU

Not sure if this is the right place, or if there even is a right place to post this but here goes.

 

BK was discharged 11/2017

 

During the BK process I tried to reaffirm my car with NFCU, how ever at the end hearing the Judge denied it. Judge told me I can continue to pay it but if I did not then the lender (NFCU) could not come after me, other then taking the car back.

 

I have been paying it and keeping it up to date since then, but no longer can afford to as well as the car is severly showing its age with major engine repairs needed that put it well beyond the value of the car. I called to voluntarily surrender the vehicle, the BK specialist told me my loan was included, but then removed from the BK. I have paperwork showing the denial as the final step with the approved discharge by the court.

 

The car payment has been 100% paid on time since then, and insurance and reg is up to date as well. Am I in the wrong to think I can surrender it with no liability? Thewy basically told me on the phone they need to speak with their lawyer and get back to me. I plan to give them a few business days and then walk in and surrender it to a branch if they won't take me seriously, because I do not plan to make the next payment nor wait for them to get around to it.

 

Any input or info would be appreciated!

are your payments showing up on your credit reports?

Yes they are, they never stopped reporting them. The gentlemen on the phone also informed me that he wasn't sure if it was an error or not as to why it's showing up.

I just went through the same thing with my credit union about a year ago, All you have to do is turn in the car and they can’t come after you. When you don’t reaffirm on the loan that’s why they don’t report it to the credit bureaus.

If they report it then it was an error on there part. Call your lawyer and see what He/She says. In my case they wasn’t reporting it and all I had to do was turn it in and no one as come after me. Good luck

Generally, they only report if a loan has been reaffirmed.
