Remove a Bankrupcty

My spouse filed for Bankruptcy in california by only themselves, some cards I had at the time had to be included on the petition as community debt and I received a "phantom discharge". I am now trying to get a home loan and some of the accounts are reporting as if I have a personal  bankruptcy on record, they should just have a notation of "included in bankruptcy" as far as I know. What can I do to get these accounts to remove bankruptcy status as my name/social security number has never been included on a bankruptcy filing, they should only be reporting bankruptcy comments, not a bankruptcy designation/status if that makes sense.

Did you continue to pay the cards? Keep the account(s) open? Do any of the cards have balances?

 

I'm not a BK pro, but this sounds a bit "different" or I'm missing some details.

Did you get copies of your updated CRs and see which ones it's showing on?  After that, I would go to the CR websites and file disputes.  There are reason listings when you file a dispute such as "Incorrect information" or "account too old," and similar.  For your case, it might be better to call directly and ask for a supervisor.

 

I'm only going by what I did when I was asking for early exclusion of my BK7.  Did everything online but your case is different so talking to a person may be a better way to go.

Depends on the accounts

 

1)  Were you a JOINT Cardholder

If you were a JOINT Cardholder - the Original Creditor (OC) can always go after your directly.   Depending on State Laws/Statute of limitations etc (Depending on Marriage Laws too)

 

or

 

2) Were you an Authorized User

-If just an AU - dispute the account as not yours it will be deleted completly 

 

If you yourself did NOT file for a BK - dispute it.      Also get a copy of your Lexis Nexis Risk Full File Disclosure
