I am trying to improve my credit score after dismissing my chapter 13 bankruptcy. I'm looking at my credit report and I noticed that my American Express credit card was reporting me late (payments) during the two years that I was under the chapter 13. Are they allowed to report me late while I was under bankruptcy and if not, can I dispute this?

As I understand it, if one has a Chapter 13 dismissed, then all previous debt go active the moment the dismissal is in place, and by "active", I mean they act as if there was nevery a bankruptcy or a stay in the first place. Disputing those late payments will only "poke the bear" and cause your scores to drop further.

When you dismiss the chapter 13, it's as if it never happened except for the public records section where it mentions you filed for chapter 13 two years ago and maybe some of the trustee payment went to Amex. The trustee payments are usually nowhere near enough to avoid the late in the event you are dismissed. So the lates from during the 13 that have started to report now are totally legit.

What was the reason for your dismissal; did you request it, or was it driven by the Trustee? Are you planning on refiling for a Chapter 7?

I requested the dismissal. I got a loan modification on my mortgage to help save my home from foreclosure. So I was just curious on how Amex reported me late during my bankruptcy unless they added all those lateness after I dismissed the chapter 13.
How did your loan modification work? I'm too in a 13 filed on 8/2/2019. My auto loams are paid off so now it's pretty much just mortgage arrears of around $13k. My mortgage is with Wells Fargo. Your mortgage company worked with you and put all your arrears into the modification? My Fico is 646.
