Student loan reporting error, now spreading

Hey myFICO'ers, sorry about the upcoming rant but I need to vent this really quick.

 

So, last month I went about cleaning up some issues with my TU report (as described in this thread ).  I had made the *now glaringly obvious mistake* of calling in to TU to see whether my batch of items (basically, all of my IIB accounts were not displaying "discharged" in the remarks, which I believed was suppressing my TU scores) were just a simple clerical error that could be quickly corrected without going through the formal dispute process.  The CSR ended up just submitting a dispute request by phone, which I think would have been fine except that she kept getting accounts wrong as I was telling her which ones I was intending to fix and I had to keep correcting her.  So the call was a pain but eventually we got through the list of accounts-in-question and I finished the call.

 

Two days later, my TU report updated with new info to CK and myFICO.  Unfortunately, it turns out that none of the accounts I had requested to be marked as "discharged" changed status, but three other accounts that were previous not in adverse condition were now reporting as IIB.  Two were old CC lines that were closed by me a few years ago (so they can't have been IIB in my Dec 2018 filing), and the other one is one of my two active federal student loans (which obviously can't be discharged in a BK7 under most circumstances, and certainly not in mine).  The two CC lines probably didn't have much of an impact since I had several other CCs that were IIB, but that student loan error reduced my reported student loan debt by about $7k and introduced a brand new negative onto my TU report, knocking down my score about 10 points further.  As you might imagine, I was pretty pissed about this.

 

So these were obvious errors, and I intended to contact TU again to resolve the issue, but it was the weekend and phone support was not available.. but I saw that I could file a dispute online.  So I did just that... I was thorough as possible in my explanation of the problems within the limited character fields, submitted the dispute, and kicked back to wait it out.  And that's been 2 or 3 weeks now, with no closure to the case.  But I knew my student loans (which had just recently re-entered repayment status) would be reporting payments soon, so I was keeping my fingers crossed that the student loan issue would correct itself when my loan servicer reported to TU what the correct status actually was.

 

BUT THAT IS NOT WHAT HAPPENED! 

 

I checked my Experian report this morning, just keeping tabs like usual, and it now shows an 11 point decrease.  Alarmed, I checked the report details... and that same student loan line which TU had screwed up is now showing on EX as "included or discharged in Chapter 7 bankruptcy" with its debt balance reduced to zero and a brand new red mark on my report for June 2019.  myFICO'ers, I am ***LIVID*** right now.  And I can't do anything about it now because it's Saturday and I can't call in to either bureau or my loan servicer.  So I just have to stew about this all weekend long, ugghhhhhhh...

 

CK and myFICO aren't picking up the change yet, but I'm pretty much expecting that this error also spread over to Equifax as well.  So I'm at a bit of a loss 'cuz TU is the one who screwed it up, then they failed to correct it with my first dispute, and now my loan servicer is telling the other bureaus the same erroneous information (and yet when I log onto my account with them, everything is fine and they are happy to continue taking payments on this account).  I guess I am going to have to get my BK attorney involved...?  But he said to me before (about an unrelated dispute issue that I have since gotten fixed) that I need to show earnest effort to resolve the errors by showing proof of at least two disputes that the CRA or creditor refused to fix so that we can prove willful neglect under the FCRA.  So it's irritating that this is going to take at least another month or two... and my rebuild was going so well, too! Update:  Earlier in the week, I went ahead and filed a dispute with Experian on the student loan account.  Still waiting to hear back on that one, but TransUnion finally finished their investigation of the dispute I filed last month.  They came back and said everything was accurate, so they didn't change anything Smiley Mad  So it looks like I'll be filing a new dispute with them this week.  

 

I also called my student loan servicer last night to ask them about what's going on.  They confirmed that the account should be showing as open, current, no derogatory remarks or status, and with a balance of around $6500.  The CSR asked me to upload the TU and EX reports which show the incorrect information and they will investigate further, so I'm hopeful that I can get the correct information restored by working with the loan servicer directly.

I know you are frustrated but you have to slow down. The error will fix itself on its own. Once the student loan company got notification from the bureaus they would have submitted proof it was valid and the account would of went back to normal.

I actually did ask the servicer about that last night, because my expectation was that the account status should have been corrected on the CR once the servicer reported the recent June 2019 payment and status.  The CSR told me that TU had contacted them in June to verify reporting information based on my dispute, but they didn't actually talk with anyone to clear up any misinformation.  I still don't understand how the misinformation from TU got over to EX if the loan servicer is saying that they are reporting the account status as being in good standing, and the CSR couldn't explain that either. 

 

I agree that, in theory, the problem would self-correct, but my experience is showing that to not be the case.  So now I have to be proactive in attempting to fix the issue so that, if they still won't budge, my BK attorney will then be able to go after them on it.

It all leads back to the OC. The CRA's dont know anything about your situation unless they are notified or they entered info from the OC incorrectly. As far as IIB. Anyone that doesnt report the accounts IIB from your BK. Then contact your lawyer and have them fix it with the OC. If they dont then you could collect $1000 rewards for violating BK Laws. One CRA doesnt talk to the other. Someone at the OC messed up.
