ch-7 bankruptcy return-to-sender notifications

PNC bank covers up the real address to their bk department. Are they going to pull a fast one after discharge?

The courts have been clear that if no assets are distributed to creditors, the debt is generally discharged regardless, unless some other exception to discharge applies. Which in my case doesn't. My 341 meeting is in six days so I'm not sure what I can do for the time being.

Maybe send a copy of discharge down the road?

Des, thank you for responding. Unfortunatelly that is the address that's marked 'Return to Sender'.  My 341 is coming up Thuesday next week so it's too late to make another round of mailing. I had an unsecurred credit card with PNC so it's likely not a big deal.

In the Northern District of Illinois Bankruptcy Court, a Local Rule says that if a no asset chapter 7 debtor gets a discharge, then it all goes away even if they forgot about it and didn't list it. You have to make a good faith effort to put as many things on the schedule as you can remember, but it all gets discharged.

 

If PNC is on the bankruptcy schedule, then the discharge should protect you whether they get the notice or not.

 

I had a landlord who thought she was being cute and didn't accept the letter from the Bankruptcy Noticing Center, and it didn't change anything other than she didn't know what the court dates were if she wanted to come argue that I might have owed her something other than unpaid rent.

 

When we moved out of there, that woman was insane, we had a lot of problems with her, and her other tenants, and it was not our fault. I have no reason to lie. But she went in and started making up fake charges. She put on an invoice that I accidentally exploded a Pepsi before we moved out and that she had to buy another refrigerator for $1,000 I went and opened the refrigerator and unplugged it to let it thaw and clean it up, plugged it back in, the fridge worked fine. There was nothing the Pepsi got on except the solid plastic on the side and bottom and top, it didn't go into any of the mechanisms.

 

There's a lot of unsavory landlords like this. 

 

Anyway, the short of it is, I never paid any of it, including a $1500 "breaking the lease fee" she put in the second year's lease that I did not notice, which was not rent. 

 

She never did get paid. And my ex was like "Just let me go pay her." and I said "Don't, it'll only encourage her to do it to someone else."

 

The funny thing was on the way in she gave us a choice between a $895 damage deposit or a $400 non-refundable move in fee that also didn't cover any damages or cleaning. I chose the fee. Why? Almost every landlord tries to take your deposit. Why am I going to hand them more money never to be seen again?

 

But the short of it is, that the debts go away in my case in any event. No asset debtor, put the creditor on the schedule. Whether they accept the BNC notice or not is irrelevant.

 

Quest Diagnostics kept trying to pursue $300 I owed them, they'd give me various addresses to send the discharge letter, and then they said I sent it to the wrong address. Finally they put it on my credit report and I got it taken right back off by disputing it as "included in bankruptcy" and showing the bureaus the letter. (This was before Illinois made reporting medical debt illegal.)

 

I wouldn't worry too much about PNC if they were on the schedule. Put down the address where you're supposed to mail your payments. That's what I did with my creditors.

 

They have numerous ways they should be aware of a bankruptcy filing, including a free noticing system by the court.

Andrew sorry to hear the shenigans that your landlord has pulled on you.  PNC is a **bleep**ty bank/cc company but the debt will be discharged regardless. I just had 341 meeting on Wednesday and no creditor showed up. As I've anticipated, since it's a 'no asset' BK7 with all unsecured credits and my car that was fully exempted. Cap1 auto loan is still current with only 10 or so payments remaining so I will ride through. By the way PNC removed all traces from Experian as if I never had an open or closed account. Don't know why they did that.

I got a PNC Virtual Wallet for a while after bankruptcy and their online banking was rickety, to say the least. It would be down for repairs all the time, it looked like it was "Best Viewed in Internet Explorer 6." even in 2021.

 

The only good thing I say about PNC is they're close to my house and they had good coffee.

 

Mom still uses PNC and the one in her Indiana town is worse than the one here.

 

Her landlord is Teresa and the teller always tries to make cashier's checks out to "Tarisa".

 

Then after years of paying $5 per cashier's check because she mishandles money like whoa and doesn't know how to handle outstanding checks, they tell her nobody should have been charging $5 a check for the past four years because she is over 65.

 

So they stuck her for $240 in fees that shouldn't have been charged.

 

Then she reported that the ATM has been broken for years and gives you less money than you asked for and debits the full amount from your account and they just keep telling her it's not even their ATM it's a vendor. This has been going on for three years.

 

Crappy bank doesn't even begin to describe PNC. Even Wells Fargo has better banking than this and will pay you $400 to open an account and make a single direct deposit within 90 days.

 

PNC has "I'm not gonna pay a lot for this muffler." account bonuses, where most people might get $100. Not even worth the hit to your new checking accounts when you could get more money out of other banks.
