Bread card questions - blacklisted/amex protections

Was looking at the bread card. Particularly if I am understanding correctly the Amex benefits. In the event fraud occurs, who does the investigating? Is it Amex or Commenity since the website mentions Amex benefits and extended warranties. 

 

Other question was, I included Amex in my BK7. But I understand Commenity is the underwriting bank. Would I be eligible for this card since I didn't include Commenity?

Insofar as fraud occurring Comenity would naturally be directly involved as they are the card issuer but depending upon the nature of the fraud American Express would also be involved as it's their payment network that processed the actual transaction.

 

Since Amercian Express is "only" the payment network they're not involved in Comenity's decision-making decision-making process tied to an application for credit.
