Capital One can sue you while at the same time approving a new card.
I'm really not sure what your chances are, given how recent your COs are.
If you're planning on paying them back, apply after you do.
If you're not planning on paying them back, wait longer, but do keep in mind that CapOne and Discover are two by far most litigious lenders out there

Looking at your signatures, it appears the OP is further along their recovery journey than you are. I think getting an unsecured card with a score under 600 would be very difficult.
To be honest, I checked pre-qual for curiosity and surprised to find it gave me offers. I have no intention of apply for CapitalOne or any other credit card now or in the future. My goal is to make settlements and get the debt out and keep my report clean. That is my goal for next 8-12 months. I have good secured with decent limits and hopefully they will become unsecure. I understand US Bank is good at unsecuring. I know Affinity and SDFCU might become unsecure. Even if they do not become unsecure in the future, I am not going to apply for new credit and get into more debt and pay outrageuous interest on credit cards. I am done with this rat race.
