actually pretty sure but when you open credit with a bank, they are allowed in the terms to pull a credit report any **bleep** time they please. so even if you wern't upgrading to visa, if they felt like it they could pull it, so an upgrade request is DEF. an agreed upon request.
No disputing that.

I say dispute it with the creditor.  The cashier didn't have the knowledge and it was offered to you.  You would have been satisfied with the same CL, right?  All they were saying was that they were going to put a Visa logo on your card for you.  You technically were not asking for new credit IMHO, just accepting an offer to expand the possibilities for use of that same credit.

Upgrading from a store card to a Visa/MC is a request for new credit.  It's an entirely different product.

Just brainstorming some ammunition to fight back.  I don't agree that its an application for new credit.  Although, legally, some would disagree.  The average consumer would not know that.   They are not members of this forum.  Of course, in their defense, they may not check their credit as often as we do here.  I would never dare an upgrade without talking to a representative of the bank first, but we have to be fair to all consumers and disclose exactly what that request entails.  Non-full disclosure is a lousy sales tactic.
