Am I breaking any laws with this letter???

Dear Sir or Madam:

RE: xxxxxxxxx

Upon reviewing my credit report prepared by Equifax, I found two (2) credit inquiries dated 01/13/06 and 02/24/07 by you indicated on my credit report that was not authorized by me. To my knowledge I have not signed any documents, applied for employment nor did I request credit from you organization to view my credit history.  Your inquiry into my credit report violates the Fair Credit Reporting Act, Section 1681b(c): Transactions Not Initiated by Consumer.

If you are in possession of any document that you believe authorizes you or your organization to make inquires into my credit report, I respectfully request a copy of this document be sent to my address listed below so that I may verify its validity. Given the amount of identity theft, I'm sure you'll agree that verifying your information is in your best interest.

Finally, assuming you do not posses inquiry authorization, I request that, after removing your unauthorized inquires from my credit profiles, you also remove all of my personal information from your records and send me confirmation that you have complied with my requests.

I do hope that we can settle this matter amicably.  You will remove the inquiry within ten (10) business days of the receipt of this notice, or I will pursue further action. Be advised that I will be checking my reports to ensure you have had the following unauthorized inquiries removed.

What company actually pulled your credit reports.  If you post their name, perhaps someone here has dealt with them before.  Do you have an relaionship with the company either directly or indirectly?
 
I am not al lawyer but I dont think there is anything illegal in your letter.  The tone is very adversarial  and assuming you havent sent the company a letter before, I would perhaps tone it down and just ask them to remove the inqs.
 
I checked the address in your letter and are you dealing with Carmax?  Did you apply for a loan with them or do you have an account with them?

mia............good letter. I have sent similar letters in trying to get questionable inquiries deleted.

The company is "1st North Amer Credit Corp".  The hard pull was actually 2yrs ago (this month).  It does sound a little adversarial, but I would like it removed asap. Since it was 2yrs ago I am hoping that they just contact the cra and have it removed. Should I turn this letter into maybe a Gw? There is no PP showing up on my CR for them.

If you didn't have any relationship with the company... why would you GW?  This letter is fine.  You could also use the non-authorized inquiry letter that is on the boards which is stronger.

Thanks everybody for the advice.  I actually pieced this letter together from a bunch of different letters.  I found that the example Non-authorzied Inquiry from tuscani a little intimidating Smiley Mad (it scared me).  I don't have any dealings so I will stick with this one.  Smiley Happy

if it's been two years, the inq's should be falling off anyway. chances are by the time they process your request they will be gone.

I used Tuscani's Non-authorzied Inquiry letter and it worked.  Sears removed the inquiry they pulled when I called them to send me a new card because I had lost the previous one.  Before sending that letter I tried a less intimidating letter just asking to remove it and they said no.

Don't sweat it. It is set to fall the 1st day of the next month after 2 years. Your letter will take about that long. After 12 months it's hardly effecting anything. If it bothers you that much call the CRA and tell them it's been 2 years, maybe they will remove it a few days early. I wouldn't waste the stamp. Great powerful letter!!! Smiley Happy
