CA no longer licensed

If a CA is no longer licensed to operate in your state.

1. Can they still list on your CR

2. Can they legally validate a dispute.

Re: CA no longer licensed

It all depends. There is no federal requirement for a CA to be licensed, but in some states there is a requirement to be licensed and a violation of the licensing statutes can bring the wrath of the state down on one.

Here in Washington, CAs must be licensed, and DOL can make the life of a CA miserable if the CA does not comply. But there's a long list of exemptions including lawyers.

Re: CA no longer licensed

i would check the consumer provisions of your state code and/or contact the state attorney general's consumer protection division for more info.  in my state, the ag's office has very helpful lawyers who will usually do a little research and get back to you.

Re: CA no longer licensed

I have done some more investigation after I posted.

This account was on all 3 CRA's and will drop 10/07

Dispute to TU was deleted in Jan
Dispute to EXP and they verified with the unlicensed CA in May
Dispute to EQ they verfified and place a new name that was unrelated but is licensed in May

Further research found these 2 companies actually merged effective Jan 13 07.

My state has very strict guidelines. For the exception of Attorney's but this is not an attorney.

So I guess my mistake was not refuting all 3 in Jan. It also looks like I don't have much of a violation from EXP as the companies merged.

My DW has a CA that we just disputed that is not licensed in AZ - if it comes back verified it will be a violation from what I have read.

Thanks-

If the CA is still operating unlicensed, then they are still in violation of state law. Doesn't matter when you last spoke with them. I'd file a complaint with the Department of Financial Institutions.
