Signing is a bad thing. There's documented cases here and elsewhere that CAs have received signed letters. They in turn scan that signature and apply it to a forged copy of their choosing.

There is no law anywhere that requires you to sign. Either they are doing it for bad or it is a stall tactic.

Re: CA says it won't validate without my signature

The address for the CA on their response letter is the same as the address on my CR's (EQ & TU are reporting, EX is not).  However, the attorney that I'm paying the debt to has a different address and phone number from the CA.  The payment coupons from the attorney's office list that the debt is in reference to the OC (Hospital/Medical) and makes no mention of the CA.  The account number reported by the CA is not the same as the attorney's.

I have not received anything from the CA prior to the response from my DV, unless it was so many years ago that I don't remember.  I checked my files and can't find anything regarding this debt except from the attorney I'm currently paying and I keep everyting!

However, I found out that the attorney's office is in the same building as the CA.  Do you think that they may be connected in some way and may sue me if I pursue this?  I intend to continue making payments on the debt, but am paying the attorney and it is not being reported on my CR by his office.  I was hoping to have the CA removed from CR.  It appears to me that the debt is not assigned to the CA, so the CA should not have the authoirty to collect and should not be able to report.

I've been making payments to the attorney since June, 2006.  My CR shows that the debt was assigned to the CA on 03/2005 with DOFD on 10/2004.  The original balance on my CR matches what the attorney stated on original correspondence and the current balance on my CR is the correct current balance, as if I were making the payments to the CA.

What do you think?

Re: CA says it won't validate without my signature

It is common practice for a CA to send letters stating that they are an attorney.....check out with your state if the name is really a licensed attorney.....he could be  but if so he is collecting for the CA.

Re: CA says it won't validate without my signature

So should I send the second DV letter to the CA or hold off?  Also, I live in FL and the CA and atty are in TN.  Should I check both states for licensing? How do I do that?

If you're in FL, check them out on www.sunbiz.org.  You can type the name in to see if they have an active liscense to do business in the state.  Check to see if both are registered as active and proceed accordingly.

Not necessarily.  The attorney was just assigned the debt for the CA.  The CA probably owns it (was sold to CA).  I also paid a local attorney for a debt that was reported by a different CA.  The attorney just forwarded the payments to the CA.

Re: CA says it won't validate without my signature

It just seems odd to me that the attorney lists the client as the OC (Hospital) and there is no mention of the CA on anything except my CR.
