Cap 1 PFD

If I send a PFD letter to capital one, does that reset my SOL period? If they don't agree will they come after me full steam because I have offered to pay the debt in full? Should I just keep quiet and wait for the debt to stop reporting (15 months from now) because they aren't contacting me as of now? Thanks!

Re: Cap 1 PFD

That depends,  do you need it off to obtain a better score for a line of credit?.  Are you currently looking to get a mortgage, an auto loan?.   If the answer is no,  I would just let it lie low and wait for it to drop off.      It's beyond the Statute of Limitations so you don't have to pay it.   Let sleeping dogs lie.

But if you do need it off for lender reasons, then you have major leverage in getting a PFD.  But to utilize it you must let them know that you know it is beyond your state's SOL>   More than likely they agree to your terms, since legally that can't get a dime out of you,  but get it in writing.  Very important.

Paying or contacting a CA never restarts the SOL.

Re: Cap 1 PFD

Paying on an old debt DOES restart the Statute of Limitations.   It doen't restart the time allowed to report.  But it does restart the SOL on how long they can legally sue you.

Two different situations.

SOL - How long a creditor can legally persue your debt in court.

CRA  reporting age  -  7 years

You are correct... However, this is not a legal forum. Any reference to SOL should assume we are talking about reporting SOL and not legal SOL.

Re: Cap 1 PFD

I think we should state whether people are referring to either legal SOL or CRA reporting time limits and not assume.   It seems alot of people get the two confused and they are very very different sceniero's and if we leave someone with the wrong impression of which is which that could have disaterous consequences.
