Capital One CC - Dispute

My husband and I have been trying to rebuild our credit in the last 5 years - after BK and foreclosure. We each applied for a Capital One card, in fact, we each have 2. At one time, both my car loans were also under Capital One. I refinanced one of the auto loans thru a local bank but one remains with Capital One. Last fall, I mistakenly scheduled two payments for the same month neglecting payment for the following cycle on one of the CC. I would agree that it is my fault. All the rebuilt credit accounts have stayed in good standing except for that ONE CC. I found out there was a late when I pulled my credit report in January. I contacted Capital One to explain my mistake and wanted to see if they could help me remove the ONE "late 30". The first agent seemed very sincere and wanted to help. He transferred me to an "account specialist" where after he reviewed my account said: "it is not a mistake made by Capital One so we cannot remove the late 30 but I will submit your dispute to the Bureaus to see if they can allow the removal". A few days later, I received two letters from Capital One. One letter stating that after further review of my account, they did not see a missed/late payment for the specified month: August (which was the month I made 2 payments for). The other letter stating that it is a fact that they did not receive a payment from me for the specified month: September and because of that they could not remove the "late 30". So in February, we decide to try to see if we could qualify for a house loan. At first, our LO runs our credit and says we can be pre-qualified. It took us a few months to think about whether to proceed. After much discussion, we decided to start looking to buy a home. Now, our LO states that the Capital One CC account shows "account in dispute" (same report from Feb). The LO says we will need to remove that asap since it will be a hang up in underwriting if we put in any offers. I contacted Capital One a few days ago and spoke to two different agents (only because I forgot to ask for a letter from the first one) and both verified that they do NOT see any late payments for any of my cards, that the accounts are in good standing and none are in dispute. I asked the 2nd agent for a letter to confirm this and he said one would be mailed out in the next 4-7 days. After the calls, I felt really relieved that Capital One would help me. However, after thinking back to those letters I received and searching for experiences online re: Cap One, I'm starting to feel like I may have gotten the run around from them. I don't want to re-run my credit nor can I have my LO do a rapid rescore until a letter is received from Cap One. Has anyone had experience with something similar? I'm so scared they did not fix it and if they didn't, how should I proceed?

if it's just 1 credit report showing in dispute I would probalby just try to call them directly and ask them to remove the account from dispute status.

@creditaddict I did try calling. both agents said my accounts did not show any lates or any accounts in dispute. so they would not be able to "remove" a dispute that wasn't there.

This is a pretty easy fix and will take about 5 days if you make the requests today.  Anytime you dispute anything with Capital One, they leave a comment in the comment section of your credit report during the dispute that remains after the dispute is over.  It does have an effect when applying for new credit and needs to be removed.  It's very likely the comment is on all three credit bureaus.  It takes a simple call to all three bureaus and the comment can be removed at your request.  For me, Experian did it same day.  Equifax was the following day and TransUnion took 4-5 days. 

 

I can't remember if I needed a current copy of my report (for the file numbers) or not.  I think you can do it without a file number. 

 

Good luck!  No need to worry.  I have no idea why Capital One does this but it's annoying as it can be!

@axledobe Do you have the numbers I can contact them at? all the ones I've tried only leads me to order my report and no live person.

I'll PM you what I have.  I have a feeling you're going to need a report number for them with the numbers I give you but maybe not.  You can surely try.  Just please remember, you are looking to have the comments removed (not disputes) from the Capital One tradelines.  Each tradeline has a section for comments and they just love to add "customer disputes blah blah blah" and just leave it after the dispute.

so one quick update. I received an electronic document on my cap one file over the weekend. Excited...I opened my account to find a letter stating that a payment was received in April 2014 and my current balance. How did I know that was going to happen? I haven't called the credit bureaus yet due to limit on time so at lunch I called cap one and reminded them and clarified on what I needed: 1. removal of "late 30" on my credit report 2. removal of "account in dispute" and 3. a letter stating that is going to happen and that they are going to contact the bureaus to do the same. the agent went over my request with me 3x before assuring me the correct letter will be sent out to me in the next 4-7 days. I explained my situation to her so she has also requested a fax copy to be sent in 3 days. Which the first two agents said could not be done. I'm hoping this letter is right this time. if it is, I can just send it to the bureaus and not have to get the run around there too.

oh yes, I forgot to mention, that while all this is happening... I received an email from Cap One saying: "we think you are eligible for a limit increase of $1,500...please verify your employment..."

considering I did not request for an increase, if I respond, is it safe to assume that this will not result in a "hard pull' and will the increase affect my process in trying to buy a home? In all I have 3 individual cc and 1 joint with my husband. this being my largest amount at $750 currently and the rest are $300. all with less than 10% or no balance right now. I'm afraid that if I'm given a $1500 increase, the underwriter may see it as an increased risk. thoughts?
