Car loan error

I’m not sure if this is the right forum but I need advice. I had GM financial as a car loan and I had a total loss and received a refund check. Months later they sent me a letter telling me it was an error and I have to pay them back! Can I fight this?! I used the money and I can’t afford to pay back 1,300$. Its their mistake how can they do this to people?

Do they explain what the error was?

1- If your car was totaled and GM Financial sent you a refund check, I assume the insurance company sent the check for the value of the car to GM?

2- And if GM sent you a refund I assume the amount of the check was more than the loan payoff amount?

 

If those two assumptions are correct, then what is GM saying the error was?

I would call and request an explanation. It could have been a clerical error or someone re-evaluated the value.

If they are correct and you do owe the money back they may be able to set up an arrangement for pay back.

We are all curious and look forward to updates.
