Cold call on an old debt from 1999...

I got a call from a CA today for a CC that is from 1999 and I asked
him if he was able to do that on an account that was past the statutes of
limitations, he said it was still a collectable debt and I said I would get back to
him on that.
I live in AZ and it is a closed state were no one can send or call on debt from outside the
state so I was wondering what my next course of action should be..
seams he did 2 things wrong here...

Re: Cold call on an old debt from 1999...

If the debt is gone from your CR and SOL is up you're good to go ~ don't worry about it!

If the debt is older than the SOL in your state tell the CA that they are wasting their time and yours as the OC or CA can't take you to court for a judgement.

Here is the SOL in AZ

Oral Contact        3 years
Written Contract  6 years
Promissory          6 years
Open ended accts  3 years

State Statute 12.543

Re: Cold call on an old debt from 1999...

Thanks kim..

I believe the account is from California but I reside in AZ for the last 8+ years..
Arizona is a closed state to collections from outside the state so they are violating
something there...
It seams when you pay off debt they come after you from all over to get there share...

Re: Cold call on an old debt from 1999...

I'm not sure but I think you would go by the SOL in the state you currently reside.  Just in case it's SOL for CA they are 2/4/4/4

I know..I'm worried 'bout that too!  I'm so glad to have this forum and such knowledgeable, helpful folks to guide me through this credit mine field!!

If they are violating AZ state law I would check your Secretary of States website for further info on the FDCPA.

Re: Cold call on an old debt from 1999...

Correct me if I am wrong.. But I think a collection agency can still attempt to collect a debt after SOL.  I believe they can still call and send collection letters. They just can't sue you after SOL. Maybe I am wrong..

Re: Cold call on an old debt from 1999...

I am new at this so I don't know the correct answers but I am told that living in AZ
a collector on a debt from outside the state cannot call or send letters to an individual into a closed state for collections.

Re: Cold call on an old debt from 1999...

This amount is around 300.00 wich I will probably pay, I just have been getting
slightly mad because I have paid off over 14,000 - 15,000 in debt on around 40 accounts these
past 6 months and the CA'S are having no mercy on me....
My fault for ignoring old debt and letting it sit for a number of years but the light at the end of the tunnel is in the not so distant future..
I am a month away from being 100% debt free other than my small mortgage.
