Today I received a collection call from my mortgage company. This person was very rude, started tearing into me for making my house payments 10 to 20 days late for the last few months. He wasn't letting me get a word in edgewise. Finally when he got to the point where he asked me if I was planning to keep my home.. I just hung up.. He called back a few seconds later. He told me he was trying to explain something to me when I hung up on him and wanted to continue. All it was is a continuation on his rant about how I should be making my payments on or before the 1st of the month. I told him to immediately cease and decist all calls. I don't want to speak to him again nor do I want another collection call from his company ever again. He told me he couldn't. He said it clearly states in my mortgage papers that if payment doesn't arrive by the first of the month it goes into collection. I told him I don't want any collection calls. He said "NO WE CAN"T DO THAT."
I should be making my payments on or before the first of the month. With the economy and my financial situation.. I am doing whatever possible I can to keep all my accounts current. I haven't had a 30 day late in over 3 years with any accounts. My payments might be a few weeks late, but I am doing whatever humanly possible I can to keep my payments current. This mortgage payment is $198.00 a month, and I only owe 15K on it..
Anyway.. When the collection agent called me back the 2nd time after I hung up. Is that violation of Fair Debt Collections Act? Is it worth filing a complaint on it?

I am hoping someone with more experience will be able to give you advice. Were these calls from the original creditor? I'm assuming if you aren't 30 days late, that they are not from a collection agency.
I read once in the forum that rules that cover how collection agencies can call and collect do not cover the original creditor. I am not certain of the accuracy of that, but hopefully someone else will let us know.
