Collection reported as a tradeline (is it legal?) (Midland Credit Mgmt & LVNV Funding)

Midland is reporting an old Sears card charge off account as a tradeline on my Experian and Equifax reports. Is this legal? I recently paid it in full.
90+ days late 11 times (Dec 2007, Nov 2007, Sep 2007, Aug 2007, Jul 2007, Jun 2007, May 2007, Apr 2007, Mar 2007, Dec 2006, Jan 2003)

 

LVNV Funding is doing the same...

 

If these were reporting as a collection accounts they would have very little affect on my scores since they are so old.

If it were shown as collection it could lower your scores 30 - 50 points.  You say that they are old...what is the DOFD?  and SOL?

I have a queston about this.  I have a collection from a 2003 Sprint PCS account that I paid in Summer 2006 to Calvary Portfolio before I knew about PFD (not that Calvary does those, as others here have said they were turned down as its against Calvary's policy).  So it shows as opened Dec. 2005 and paid Aug. 2006 (though for less money then owed).  On 2 of my credit reports it shows as a proper collection, but on my Experian Report it shows as a tradeline with a single 90+ day late and yet when you look at it it clearly identified as a collection in the description.  Its just that Experian doesn't list in on the collection page or in the summary. It has been consistantly like this since the past summer.  I don't know about before that since I never pulled a report from when it first showed up in Sept 2006 after I paid Calvary off(doh!) and late Spring 2007. 
 
What is better for my credit, a tradeline with a 90+day late or a collection?  Should I dispute this with Experian or leave this dog sleeping?  When I compare my scores between the 2 that show it as a collection and Experian, they are all within a couple of points of one another though Experian is my highest score.

I have the LVNV on my account too showing open and 120 past due, which is crap, it's like 5.5 years past due, they bought the account...you definitely need to DV both Midland and LVNV because they both don't own it.
 
And watch it, if you end up in court be sure to point out they BOUGHT the account for pennies, they should NOT get same rights as assignee...personal experience - I have trial in April to determine the amount I owe because I disagreed and didn't get it out ENOUGH to the judge that it was purchased!  BIG difference.
 
Since she granted partial judgment (meaning I owe something) she gave them "assignee" rights...so my case will be they actually purchased.
 
There is something else, they sent me an offer of $1500 - I said $900 in my reply because I know they only paid about $13.00...our order says we are supposed to go through mediation BEFORE trial - I have NO intention to initiate mediation since I'm not the one suing...I just don't know if this little offer & counter-offer count as the so-called mediationSmiley Happy
 
Separately, I'm going to go after LVNV for violating my rights by reporting the same account twice, and verifying it's legitimate - so I've dealt with that for two years as well...I'll use the latest date of May so I have the one year.  I'm doing it in small claimsSmiley Happy
