DV response - help needed!

I sent a request for verification to a company that I truely do not have ANY recollection of doing business with and this is the reply that I received: "Thank you for your recent inquiry to Card Holder Services. After reviewing our records, we are unable to provide you with your original application, sales receipts or historical statements as this information is no longer available or has already been provided to you." "Please be assured that we appreciate your desire to correct your credit rating, however we can only remove or change information that our company incorrectly reports to the credit bureau. We believe that the information we are reporting is accurate. If you wish to continue disputing the information on your credit report, please contact the bureau directly for further instructions" And the funniest part, "We appreciate your business and value you as a customer." So, what do I do now? I thought it was required that they provide proof of the debt when requested and if not, they HAD to delete? Help! This is one of the last yucky things on my report that I'd like to get rid of especially since I have no clue about what this was for in the first place!

Unbelievable. I'd send a copy of it to the CRAs and quote the FCRA laws that require them to validate and not report unverifiable information. Clearly a compmay cannot report a debt it just admitted it has no records for just because it is 'sure' it is yours. You can find those statutes her if you search for them, I don't have them handy.

I'd also find some laws/statutes to quote in a letter to the CA/OC that only REQUIRE removal w/o validation, but laws that include fines for not doing so. You might even want to contact a credit-attorney and make some money off the dumb b*!@#*$!

Thanks, I am going to find the FCRA laws and send nice faxes to both the OC and all 3 CRAs. I had to reread it after I read it the first time - I couldnt believe they put in writing that they can not verify but will not delete - thats crazy.

Nope............DVs do not apply to this OC. The FDCPA did not apply to them. They do not have to provide any info. However, a dispute to the CRA may be in order if they are reporting incorrectly. I would mail it along with any documentation that supports your case.

The only documentation that I have is that I have NOTHING. Never heard of them. How do I prove that I dont have any knowledge of them other than to say I have no knowledge of them?

This is me, but I would send an OC letter, like those found in here. If the response is the same, and I was 100% certain it wasn't mine, then I would consider filing a police report. I would use this report to dispute with the CRAs as an ID theft issue via mail.

Once an OC verifies a debt during a dispute to the CRA, they do in fact have to provide documentation. It is just not the 'DV' letter here, it is the 'OC' letter, which is bascially the same with different laws quoted. Try a search here, I can see if I can dig mine up.

I 'OC'd' Household Bank who had verified twice during disputes. However when I 'OC'd' them, i.e. said they had to provide contracts, statements, etc. they investigated, could not find, and dropped.

NO ONE can report a debt to the CRAs without proper documentation. And to claim the right on their part is ludicrous. Crush them mercilessly.
