Dilemma

Here's my dilemma.  I had a mortgage with a company from '02-'04 at which point I refinanced.  There are 5x 30 day lates showing up on this account. Here's where the problem lies, the dates of the lates were in '01 before I even had a mortgage which is easily proven; in fact the house didn't even exist in '01.  The lates occurred in '04 the reason I know this is because my area was hit with 4 major hurricanes that year and we suffered financially.  I also requested the dates of lates from the mortgage company and they show 2004.  I remember them telling me at the time not to worry since my area had been declared as a disaster zone that they wouldn't be reporting us late (no I don't have proof, it was all verbal).

Here are my questions:
  1. Should I pursue anything further?
  2. The account isn't schduled to fall off until 2011.  If I send proof to the cras that I didnt have a mortgage in '01 would they contact the mortgage company?
  3. Lets say they do contact the mortgage company and they update my lates to 04, it's still will fall off in 2011 right?
  4. Is it hurting my score less that the lates are being reported in '01 and not '04?

I tried a GW but I got the usual, "we must report accurately blah blah blah."

Re: Dilemma

Actually, I think there is some sort of federal reg (either thru FEMA or someone) about the late reporting - I remember hearing about this but it is just a vague memory.

Re: Dilemma

I thought I read something at the time also about late payments when being in a declared disaster zone.  I guess Im going to have to research it more.
