Disputes???

long story short. I'm currently disputing a collection with all three bureau's. TU said they called and the CA confirmed that it did not belong to me- result, Deleted after three days.

EX and EQ have yet to even give me an update on their progress of the dispute. I'm aware of the time limits and the processes in which they have to follow, but why do they need so much more time? Do they usually drag it out the full 30 days?

Maybe they are working other cases that came in before yours?

If the furnisher of the disputed information (in your case, the debt collector) positively finds that the accuracy of any information disputed via a CRA cannot be verified, it is not sufficient for them to simply report that finding to the CRA handling the dispute or to delete their reporting only with that CRA.

 

If they agree that the accuracy cannot be verified, then FCRA 623(b)(1)(D) states:

"if the investigation finds that the information is incomplete or inaccurate, report those results to all other consumer reporting agencies to which the person furnished the information and that compile and maintain files on consumers on a nationwide basis."

 

You can contact the debt collector and remind them of their obligation to have deleted the collection from ALL credit reporting agencies to which they have additionally reported.

I had initially contacted them prior to the dispute, I was not getting any answers and was told I needed to pay the amount in question. I stated it wasn't my debt so I will not pay it. So, I was advised by a friend to dispute it. Which I did. And was deleted in a matter of days from TU. It seemed as if they wanted no part in talking to me or hearing what I had to say.

Unfortunately, if you file a dispute and the next step is simply a deletion by the debt collector, that is not per se a statement on their part that they have found the reporting to be inaccurate or unverifiable.  It is, in essence, a voluntary deletion without confirmation of an actual inaccuracy of that the debt is not legitimate.

Thus, it is not basis for mandating deletion with all CRAs.

 

In the case of a voluntary deletion based on a dispute with one CRA, they could choose to verify or corrrect with other CRAs, so you would need a final resolution of separate disputes with each CRA.

The original post stated that the debt  collector confirmed that the debt did not belong to you, which IS a positive affirmation of lack of verifiability.

Thus, my prior statement that such a finding would also impose a requirement to report deletion with ALL CRAs.

Apparently, they deleted without an express admission that the debt was found not be yours?

How long has it been? The short answer is yes, it's not uncommon for it to drag out the full 30 days, especially if the collection agency is being uncooperative.

This is such a headache. I'd almost rather pay the measly 300.00 to get rid of the collection on my CR.  

 

I guess I will just wait for the 30 days to pass and then they have to delete it, correct? Because the obviously can't verify it.

Only they can tell whether or not they can formally verify.  

It is not uncommon for a rep to state over the phone that he does not see adequate showing of the debt/collection, and yet a full investigation then provides adequate basis for verification.

 

Yes, they CRA must conclude the dispute within 30 days of filing, and mail their Notice of Results no later than 5 business days thereafter, so you should get a Notice within appox 1 1/2 months after fiiling of the dispute.

Hello, I'm new here but been a visitor for many months. Thank you for all the information thus far. This forum is very informative. Thank you. I do have a question and I hope someone can help me. I had a collection on my report that I paid back in April. It was from TransWorld Systems, a six-year-old utility bill. When I paid my debt in April TransWorld Systems told me they would remove it from my credit report. They did not. I contacted Experian in late June and a month later it was removed. New to this, I had no idea that I needed to contact Transunion and Equifax to dispute this issue too. I did, and I do so online. Today, I called Equifax told me that there was nothing to dispute that the balance says zero. That I would need to contact the collection agency and have them send them something to have it removed. I tried that back in June during my second phone call to Transworld and they told me that they don't handle that. So right now I don't know what to do or how to get this removed from my credit report. Experian has it removed, Transunion is still working it out but Equifax said they can't help me because there is nothing to dispute since the bal is zero. So my question is, how can I get this resolved, who can I talk to? I've been working and building my credit score up to apply for a mortgage and I'm heartbroken about this. Equifax is the only credit bureau that won't help me and told me to contact the collection agency again which is useless. Please help. I appreciate any feedback. Thank you
