Experian Letter - No Answer, Now What?

I sent the letter that is found in the example thread for previously investigated items to Experian, and they received it on Oct. 19th.  So you know which one I am speaking of, it is as follows (of course the one I sent was tailored for me).

 

FCRA Section 611(a)(1)(A)clearly states that upon receipt of a dispute Experian is to perform an investigation. Oviously, this did not hold true of my dispute of xx date. On xx date I received notice from Experian that my dispute had been "previously investigated". According to the FCRA, this is not an option.

Because of your blatant disregard for the FCRA, I am demanding that the disputed tradelines be deleted from my credit report. I am guaranteed, by law, that you will report with 100% accuracy and that any account I dispute will be investigated. You have proven that this cannot be done.

You now have 5 days from your receipt of this letter to remove the previously disputed accounts from my credit report. Be advised, that my attorney has in his possession all the letters and supporting documentation regarding this matter. If the accounts in question are not deleted he will file suit in Federal Court.

 

My question is they have not removed the item as of yet (end of 5th day), so what now?  Should I give them more time?  Should I send another nasty letter?

This is a collection from 2003, so the point gain will not be much, if anything.  For this reason, I really do not want to hire an attorney to sue.  What should I do now, in your opinion?

Anyone had any luck sending this type of letter to Experian?  Thanks.

I would five more days...and if nothing at that point...I would call (if possible) or submit another letter. Good luck!

In your opinion, should I send the same letter again after 5 more days?  I do not know how I can send a more stern letter.
 
I do not think I will call them.  I am one who believes to do everything in writing.  Probably not a smart thing when dealing with CRA's.
