Expunging a tax lien

To make a long story short, the State of Indiana screwed up and placed a tax lien on my credit report. While it has taken a few months to straighten out with the Department of Revenue there, I finally received a letter expunging the tax lien from my record. Both Transunion and Experian were quick to remove the record from my report after I filed a dispute with the expungement letter I received. Equifax, however, rebuffed by dispute and said the record is still showing correctly. I've filed a complaint through the CFPB, and I am waiting on the outcome of that now. Should that not end this saga for me, does anyone know what other actions I can take to force Equifax to comply?

Wait for the CFPB to get back to you on this. Your other remedy is outright suit against EQ for violating the FCRA, one would first send them an intent to sue letter.

What does the actual public record still show?

The CRA is verifying off of that record, not the letter that someone sent you.

According to the letter sent to me by the Department of Revenue Indiana:

"This letter will serve as authority from the Indiana Department of Revenue that the following tax warrant has been expunged from the applicable County Clerk Office listed below.

[REDACTED INFORMATION]

The above taypayer satisfied all outstanding tax liabilities and applied for tax warrant expungement during Tax Amnesty 2015. Therefore, the department has determined the 1 listed tax warrant(s) is/are expunged.

Thank you for your cooperation in this matter."

The wording is a bit funky since it didn't have anything to do with tax amnesty -- there wasn't any tax liability (it was a matter of proving to them I did not work or live in the state during 2012).

See above. Transunion and Experian had no problem verifying that it is expunged from the record, and I would assume they go about it the same way. Beyond the correspondance sent to me confirming expungement, what could they possibly want from me?

Then I would send the CRA an explicit request under FCRA 611(a)(6)(B)(iii) and 611(a)(7) for their disclosure of the procedure they used to verify the accuracy of your dispute of the expungement of the information.  That mandates their disclosure of what they relied upon, and a response period of 15 days.

Equifax has reviewed your complaint and its records regarding your dispute.  Please be advised the disputed Tax Lien case number ##### has been removed from the Equifax credit file.  Written confirmation has been mailed to you.
