I filled out the identity theft report on the FTC site and printed it out. On the site it says send the identity theft report to all three bureaus. I typed up the 605b letter and copied my license. Can I submit this without police report?
No. The FTC affidavit alone does not meet the criteria necessary to block information from your credit report. FCRA 605B (capital B, not small b), requries that you MUST also include a copy of a police report (which the FCRA refers to as an "identity theft report").
In a nutshell, FCRA 605B permits a consumer to block information from their credit report with only an assertion, and without any input from or involvement of the creditor or debt collector who reported the information.
It relies on an assertion by the consumer without any verifcation or involvement of the party who reported the information..
However, to separate spurious assertions that anyone could simply make from serious ones that enable removal from a credit report, congress set the standard as requiring the assertion by the consumer to carry with it criminal penalties for any false statements. An "identity theft" report is defined in FCRA 603(q)(4) as a report that was filed by the consumer before a law enforcement agency, and subjects the person filing the report to criminal penalties for the filing of false information.
FCRA 605B requires BOTH the filing of an identity theft report AND a statement by the consumer that the information does not relate to any transaction by the consumer (as well as proof of identity).
The FTC fraud affidavit is a widely accepted form for making the statement by the consumer that they did not authorize the account/transaction, but does not meet the primary requirement of providing a sworn statement before a law enforcement agency ("identity theft report")
