HELP! Equifax refuses to delete pending dispute thats been over 6 months

So, I disputed 2 accounts on my CR back in Aug. 19th 2011 and its still pending (BOTH). So I called Equifax and asked if the dispute that was still pending was actually still pending and the CSR said yes.

 

THAT WAS 7 months AGO!

 

So I asked her, "was it ever at one point the dispute resolved?" and she said no, its still pending. 

 

So, following the Fair Credit Report Act, I asked them to delete the account because its WAYYYYYYY past the 30 day investigation period. In return, they said "no", they can't and only the original creditor who reported to them can authorize a deletion. 

 

Am I missing or misunderstanding the Fair Credit Report Act here?

Do I not have the right to have the account deleted due to no completion of the dispute within the 30 day period?

What action can I take legally?

Have you tried speaking to a supervisor? Or even the possibility of another representative? Many of them still have no idea what they are speaking about or what the laws are, even though you would imagine if they work there they would have some type of decent training.

 

I would be a little patient and see if some of the others with more knowledge will respond to your type of situation considering it is the weekend.

 

If no one responds with a little more knowledge then IMO if you still haven't received a proper response from EQ after trying to speak with a supervisor then I would sit and speak with an attorney for a consultation and see what my options are.
