Hello All
- I opened a cell phone from Cingular in late 2001 early 2002. I closed my Cingular account and asked them to turn off service, which they did not apparently and let it run for months without payment and use of it. The following year I received a collections notice for the amount of the cut off fee, I think it was 300 and the few months of payment. I talked to the first collections company when I received my first notice about the charges and was told that it would cost me even more money to accurately investigate. Strangely enough they were not around long and I believe they sold my collections account to someone else.
Now another collections agency AFNI is stating that it is a new write off and the reported day has been changed to 2006 reported and is late 120 days. So this will add additional years to the already reported account in 2003. My question is even if this was previously reported under a different company how can this same Cingular account be only 120 days old reported and what are my options? How do I explain to the credit reporting agencies what I’m trying to say in credit lingo?

I’m a noob. I was reading another post that said "the charge off date is the starting date of the debt" How can these people change dates like that? Is there a law protecting the consumer from things like this? I was ready to pay them, now I would rather take that 700 to a lawyer or something.
Also do you guys know if there are lawyers that specialize in this area of consumer credit?
I wonder how you could get the same proof they send to the credit agency.

To get the information on the original debt, I know it’s been a few years can they still provide this after selling to a collections agency? If so what letter would you call that and are there any pre made?
I have the original contract and I believe a few of my credit reports from that period that show the first collections agency with the date due.
I found a thread on here know as “ReAging” and that is definitely what is going in my case. I live on the DC border and might stop by the FTC and chat with someone I’m sure I can find a friend of a friend.
I want to get info together. I plan on making a two prong attack against the collections agency I believe I am not the only one. And second Cingular and the point that was made about not turning off my phone when requested. I never could get trough to Cingular or never could get them to understand me. Me in the US and them in India.
I’m sure when I called customer service in India the “herd” me and followed through with my request?..lol
In my case I knew about the service agreement and chose to pay the fee to bail out of service. I had nothing but problems from Cingular giving me free mobile to mobile minutes instead of the contract signed weekends option I was ending up with $300 extra bill. The customer service center in India could not fix this simple problem and I asked to close my phone less then 3 months later. I was aware I would have to pay but I was mad at them.
Do any of you guys know where I can get a good Original Debt template for asking for all my information from Cingular? I read in another forum that it would be good for me to contact Cingular and request bills and past due amounts. What do you guys think? What would you call this? I’m still a noob here. Thanks
