Help!!! Just alerted from EX 2 New HP's

Okay so I just got an alert from Experian today that my report changed.

I logged in and 2 new HP's are there.

1 is from Comenity from a few days ago I requested a CLI which was auto-denied because I'm under 9 months. Shouldn't this have been a SP???

The other is from Kohl's which I have an account with them but didn't do anything to trigger a HP.

Called Kohl's and they can't tell me why one was pulled today.

I've tried disputing a HP with EX before and they shut me down even if it is unauthorized. Saying they won't remove it because federal law won't allow them to...

Any advice? Or thoughts?

I would never dispute an HP with any creditor that I have a relationship with.  It can create havoc on your credit reports (fraud alerts, etc) and can make you delete a positive tradeline forever.

I got an HP from a Comenity CLI request from the Robolady last month.  Literally came as I was on the phone with her.  Very annoying.

Did you recently shop with Kohl's and make a big purchase?

Regarding the comenity account you requested an increase to your CLI(whether it was approved or declined) so they have a right to pull your credit(whether you requested it to early or not which might seem wrong if they have x rule in place you can't get a CLI before x date of having card) sometimes it is a SP, but whenever you ask for a CLI expect a HP unless it expressively says it will be a softpull or similar verbage.  So you are out of luck there on the one.

Have no clue w/regard to Kohl's someone that has the card might be able to give more insight on that, but Cap1 services the Kohl's account so might want to give the credit dept. a call and have them explain that if you didn't request anything as you mentioned.

Curiosity -

I've looked over the entire CLI portion for Comenity (Victoria's Secret) this is literally the only thing is says, in addition to a box to input your annual income:

"More Info

If you do not wish to have alimony, child support and/or separate maintenance income considered as a basis for repaying this obligation, please do not include it in your Annual Income amount.

For Married WI Residents: If your spouse is also a Wisconsin resident, you may combine you and your spouse's financial information."

There is nothing saying any inquiry will be pulled. So I'm not too sure about that one.

As far as Kohl's I called their credit dept. and they couldn't see anything they said I requested a CLI in May but that was auto-denied because I got a CLI in Feb. they couldn't see any reason for a HP this morning.

They told me to write a letter to their "Credit Administrator" for Kohl's along with a copy of the information from EX showing a HP for today.

What are your thoughts?

That's because by law they don't need any reason to pull an HP as they're already your creditor and already have permissible purpose.  If they wanted to pull an HP daily, they're welcome to.

Read more about PP here: https://www.law.cornell.edu/uscode/text/15/1681b

I guarantee you that both HPs were allowed and legal under PP and fighting them with the CRAs will possibly lead to havoc.

HPs from CLIs and applications can take weeks to appear.  This isn't unusual.  If you applied for a CLI in May, it can pop up weeks later.

Always expect an HP from a CLI, celebrate when it's just an SP.

Re: Help!!! Just alerted from EX 2 New HP's

To me I'd rather cancel the accounts than have them hit me with HP's. I have never read anyone getting a HP CLI from Kohl's....
Their credit analysts couldn't even see why one was pulled. You're saying I shouldn't write to their credit admin?

Also, okay what if someone is not your creditor and they do a HP? I tried fighting that with EX as being unauthorized but they wouldn't even file a dispute for it.

Re: Help!!! Just alerted from EX 2 New HP's

I feel like I've been reading more and more people are getting HP's with Comenity when asking for a CLI. Not sure about Kohl's, not sure if you said you requested a CLI wiht them as well or not?

Yeah you should have justed typed "Kohls HP" into the searchbar and see that's not true at all.  Not even close to true.  Here's one: http://ficoforums.myfico.com/t5/Credit-Card-Applications/KOHL-S-CLI-Caution-Received-Hard-Pull/td-p/4619572

The truth is any creditor can and will run an HP even if they promise not to if you have borderline credit.  They'll do the HP just to see if they can find any reason to give you a CLI.  The more borderline you are, the more likely an HP is.  Stop asking for CLIs if you don't want HPs.

That's up to you.  It's just one HP, I wouldn't bother, but if it means that much to you, go ahead and write them.  Chances are they will just say "You requested a CLI, we did an HP which we are allowed to do."  I have never disputed inquiries because inquiries don't matter at all unless you have a poor credit profile (which I do), and in that case, it's best not to do anything that will incur a possible HP.  Until my scores are in the 740+ range, I don't request CLIs because I am a more likely candidate for HPs.

Which creditor above is not your creditor?  If you apply for credit, they are allowed to pull an HP.  If you never applied for credit, then they are not allowed to pull an HP.

Re: Help!!! Just alerted from EX 2 New HP's

Matt4200- Exactly what ABCD said. Both Comenity and Kohls have the right to HP you anytime they so desire. You already agreed that they could, and gave them permission to do so, It might suck, but that's what you agreed to in your credit card agreement.

Re: Help!!! Just alerted from EX 2 New HP's

Also, I doubt you spoke to one of their (or CapOne's) credit analysts. More likely a CSR reading from a script. Sure, you could probably mail or email the higher ups, but, again, still you already told them they could pull your credit whenever they wanted to
