Help understanding the reporting of paid collections

Hi,

 

Can someone help me understand this?  I would like to know what (if anything) I can do about a paid collection that is over 5 years old?  I live in NY.

 

I was under the impression that a paid collection should not be reporting past 5 years once it is paid (for NY) is this true?  I've tried to get Experian to delete and the have refused, updating my report to read, disputed and verified (something along those lines).  Eq and Tu deleted it without my intervention.   I know this is hurting my scores a bit.  It is due to fall off in 2/2012 (7.5 years), but I would like to have this off the sooner the better.

Others had issues with EX too. What seems to work for most is to write a letter to EX for the dispute and enclose a copy of NYS' statute on the 5-yr CRTP. Of course make sure your CR reflects a NY address and enclose ID to show that.

I would only add a procedural suggestion on handling this.  I would not call it a "dispute" per se, as the CRA is apt to interpret this as a dispute of inacurate reporting by a credtitor under FCRA 611(a).  In fact, it is not.  It is actually a complaint of CRA violation of FCRA 605(a), and the NY state version of the FCRA by continuing to include this CA in your CR beyond the dates specified y those statutes.  The CA has no involvement in such a complaint.

Hi, Thank you for the response, but I have already sent EX a letter along with the stated laws reagarding the reporting past the FCRA and all they did was note on my report that I "disputed" and that it was validated...urgh!

 

It's due to fall off 4/2012, I guess there is nothing else I can do?

You wouldn't want to cite the FCRA since that is 7-7.5 yrs. You needed to cite NYS's statute.
