is the latest candidate for lawsuit #10 of 2008.

 

today I checked my full report and found an account review inquiry from these scumbags back in September. Non-PP inquiry, no dunning letter, no license to operate in my state.... How dumb...

 

DV letter gone, as well as ITS letters with 3 days to fix the inquiry, 7 days to pay the FDCPA fine, then I'll file suit on Christmas eve.

 

Tomorrow complaints with the AGs, BBB, FTC, Collection Agecy board, Department of Licensing, is going to be a busy morning...

Filed all the complaints today. I have found that they are owned by Cerberus, which now owns Chrysler, are a preferred collector for MBNA and GMAC, but also they are joined at the hip with Asta Funding and Palisades Collections - Asta is the public company that owns Palisades and others.

Asta has some loans based on a portfolio shared with Hilco.... Partners in crime...

These people are the scum of the earth.

 

their general counsel (top dog lawyer) had the guts to state that "considering to purchase a distressed account" is permissible purpose to request a consumer's credit report.

 

he also had the guts to state that since they decided not to purchase and not to pursue the matter any further, they are not bound to FDCPA rules.

 

I have requested the AGs that the executives of this firm be prosecuted and be subject to penalties per FCRA 619 - 2 years in jail for procuring a credit report under false pretense for supporting and enticing illegal behavior at their company.

 

I'm so deep in writing the paperwork to sue them tomorrow morning...
