I am also being sued by this company and my account as well is pass SOL but here is my mistake.  I answered the letter saying it is my account but don't have the money to pay it and I mailed it back to the court through regular mail.  I have since recieved one letter from the attorney thanking me for responding and that was it.  So now iI think I basically screwed myself.

No I'm in  CT. Gonna call court house tomorrow since I haven't heard anything.  Not sure if there is a court date or not, haven't heard anything.

Hi Happy Days,
 
I'm not sure what you are saying that I should call the courthouse and ask for.  I have the summons in my possession and I was served properly.  I am in the state of Florida currently as well.  I have put some calls in to some attorneys and will follow up with them today. 
 
In addition could someone enlighten me on what exactly DISCOVERY is.  I have looked through the forum and can't really find a definition of it. 
 
And when you say mail a CMRRR to them, are you speaking of the creditor?

Another question FOR ALL:  Is it wise to send a DV when a debt is scheduled to fall off in a few months (even though they are suing me)? 
 
Anyone familiar?

Hey, you're getting sued and the debt is about to fall off. You need to do all that you can in order to stack things in your favor. They can't increase the CRTP, so go for it.
