Hi,
I'm actually making this post for my mom. I'm helping to repair her credit. She doesn't really use credit cards but has bad credit because my older sister has taken out credit cards in her name. Currently she has 3 in collections.
Chase $1,980
QVC/Syncrony/Portfolio Recovery Ass. $485
Care Credit/Syncrony/Portfolio Recovery Assoc. $723
She also took out a personal loan for $1,100 with Affirm that is still open (she's paid it late 3 times)
My sister lives with my mom. They have the same address. And my sister obviously knows everything about my mom's identity to be able to open/use the credit card.
I'm wondering what can be done to dispute it. Or if it can be done. My mom had no idea about these.
On paper it probably looks like it's my mom's credit card. If any mail was sent to the house, my sister easily intercepted.
I heard you might have to file a police report for this kind of thing. My mom will absolutely not do that. Is there any other way to do it without getting authorities involoved.

Unfortunately not. Your mom will need to file a police report for identity theft and submit that to the lenders and bureaus. She needs to prove the debt isn't hers and that's the only way.

The only true way to deal with this that doesn't make Mom financially responsible is to fill out an identity theft report with the police and a FACTA identity theft report. Whether or not the creditors pursue your sister is unknown. This kind of identity theft is prevalent because the perpetrator banks on (no pun intended) literally and figuratively on the victim not wanting to make waves in the family or cause problems. Mom is not doing her any favors by allowing this to continue. If she isn't going to handle it legally then her only recourse is to try pay for delete on the debts.
I know Mom doesn't want to hear this but she needs to freeze her credit reports NOW. She needs to confront the offender and demand payment. Then I would put her out of the house. Make sure sister knows the bureaus are locked and that only YOU have the code to unlock so that she cannot open any more accounts under Mom's name. Also notify Social Security of her identity theft and perhaps Mom can get a new SS# that your sister doesn't know as well. Good luck.

Is it possible Mom would give you financial power of attorney to deal with this mess? Another option is for you to confront Sis and bluff her by telling her that in order to avoid criminal charges she can pay it all right now and any further use would result in arrest. Unless she is that savvy of a criminal and knows you are bluffing.
@Peace_O_MindWelcome to the forums. So sorry their are family members that pull this stunt. Usually who does it. Get it all cleared on the creditors side. File the police report as required. Then. Pay up or enjoy bologna sandwiches.
Your mother would need to file a police report, and press charges. I have dealt with a similar situation with a family member, and it's the sole reason why I have a charge off on my record because I was not willing to press the charges. Each transaction on credit card m in my state was a felony, and lets just say their waa a lot of transactions.

That still won't fix the credit which is what the Poster is asking. The only way to do that is as all others have said, file police report and prosecute for Identity Theft

@Peace_O_Mind , this is a very tricky situation. I'm guessing older sister is helping out Mom by living with her (chores, shared expenses, etc)? The only way to attempt to fix something like this is to explain to Mom that this could get worse and you would like to step in as a buffer/intermediary. This way Mom is not the bad guy. But if a kid is willing to steal from their parent which is what she is doing, both identity and financial, I can only imagine what else she is capable of.
My recommendation - talk to Mom about a power of attorney. Not sure of laws in your state but it can cover both financial and medical decisions. If in your state they are separated, do one of each. Many believe this is an expensive legal contract but that's not true. In most situatons all you will need is the generic document and the fee is cheap (range $200-500), given the value of protection is priceless. Hopefully your family has an attorney that you use or just find one locally with a good reputation (online reviews/referral).
Once this is done, you can do a few things:
- Take the document to the local police station and file a report for your Mom. Let them know the situation and that your Mom doesn't want to file charges but you want to protect her financially nonetheless. They will tell you whether or not you are able to file for her in your area. Since the amount is small, I would not expect them to open an investigation without being asked to do so.
- Contact the credit bureaus with power of attorney and have them freeze all reports and activate fraud alerts.
- Contact the creditors with the power of attorney (and police report if you get it) and dispute the charges. Ask that they close all accounts and remove from Mom's reports.
If they leave the charges on Mom's reports -
- Contact the credit bureaus with power of attorney and dispute the charges.
- Finally, confront your sister. Let her know you hold the power of attorney and will not allow her to use your Mom's credit for her own gain. That you've filed a police report(w/o charges) and notified the creditors and credit agencies. If she attempts this again there will be repercussions.
In my opinion, it's best to get this all out in the open now, before it gets worse and destroys family relationships. Good luck!
