Are you certain its a hard inquiry? Where is that detail coming from?
Hard inquiries are for requests for new or additional credit. It sounds to me like you aren't requesting new or additional credit, so there's no reason you should be receiving HPs.
When a party requests your credit report, FCRA 604(f) and 607(a) requires that they submit a statement of the permissible purpose under one or more subsections of section 604 that provides their specific permissbile purpsose.
In the case of the posted scenerio where an existing creditor is making an inquiry for the consumer's credit report, if it is only an internal account review permissible purpose (FCRA 604(a)(3)(F)(2), CRA policy will code the inquiry as soft.
However, if the inquiry is stated as for the purpose of collection, internal or external, on a delinquent debt, it is also a permissible purpose under subsection 604(a)(3)(A), for which CRA policy does not mandate coding as soft.
The creditor could continue to make inquiries forever as long as the account remains unpaid, and thus remains under collection.
There is no time period after which inquiries are prohibited under FCRA 604 as long as there is still a permissible purpose, such as collection on a delinquent debt.

Yup, as long as it remains unpaid they can make their inquries though most do it with SPs, this is a spiteful organization you are working with.
