Yet, as you see, she said LVNV removed it on 2006.  but yet, LVNV pursued a judgment on me in 2007 and won by default.

 

I got that judgment overturned in 2010.  but we still are going there to determine what i owe.  I just need to prove that it was pass the SOL.


 

If it went delinquent in 2002 it would be off your report in 2009.  That does not necessarilly mean the suing SOL was/is up.

 

What state do you live in?

Well, I guess it is then.  Which means they pursued a debt out of SOL.  Is that how you got the judgment overturned?

nope.

 

I got it overturned because I was on ebdrest and they said they served me.  Plus they wont show up.  they missed both hearings.

 

Reason we keep coming back, because I refuted the grossly inflated amount they said I owed.  Thats why we keep going back.

 

But im gathering evidence now seein the SOL has expired, to try and get the whole thing thrown out without paying anything.

In some states it is against the law to bring a suit on a time barred debt.  Check that out for CA.

 

And if it is expired and no longer on your CR, don't stress over it.  There is not much they can do now.

Some1 else told me legally, i should stop going since they arent showing up.

Why are you still going to court?  Is it from the same judgment?  I would be afraid not to show up.  When they dismissed the case, was it with or without prejudice?

 

Have you told the judge they pursued a time barred debt?

Im still going to court to determine how much I owe.  it has already been dismissed and ive already had it deleted off of my credit report.

 

I told the judge I beleived I owed them money, but not the amount they were asking.  but that was before I found out they violated the SOL.

 

So Ive havent told her that yet, she doesnt know.  We are going in this last meeting to figure out how much I own if anything, but they havent been showing up.  but Im afraid they might show up this last time.

I would offer to pay the exact amount you defaulted on.  None of their fees and interest and all that.

 

Do you know what the CL was on the card?  Say you'll pay that.

I tried, they got greedy wanrted it all, so thats why I opted to get it vacated.

 

Its off my report, so its their move.  we'll see, I dont wanna pay anything now that I know they fraudulently pursued me.
