Score watch just sent us an alert about a judgment that was place in my husband's credit.
Here is a little bit of the story... back in 2005 we were struggling with money so we made the mistake to borrow money from a payday advance place. We never received any papers about them taking legal action againts my husband. We have been working hard to pay our debt since january of 2007 and due to the fact that this was one of our biggest debt we decided to pay all the other small things to eventually move to our bigger stuff. Well... we got served with court papers and I immediately called the payday place. I didn't know better so the lady there told me to just go ahead and make payment arragments and she said that they would stop the court claim and that we didn't need to show up to court. "BIG LIE THERE" well a few days after the court date we received a paper from the court saying that a default judgment was entered againts my husband and that we needed to pay.
I was extremely frustrated because the lady at the payday lied to me big time. We did need to go to court and I was just very disappointed. Hubby and I went to our credit union and got a loan to pay them off.
The judgment was as follow: Moreover, the parties stipulate that satisfaction within 30 days this judgment shall automatically convert to a dismissal.
We paid it before the 30 days so does that means it was an automatic dismissal? also the payday filed a motion to set aside the judgment and it was granted. Can we remove the judgment from my husband's credit then? If so... how do we go about it?
Any advice would be much appreciated.
