Interesting Phone Call today...

So let's track back to early 2013. I had a few credit cards, had them for years. Paid them, didn't think anything of it. Had two with balances, but not large, and was in the process of paying more than the minimum every month to get them down to zero.  All good right? Well my wife catches the 'new house bug' and so we decided to sell our house. Well her house, she already owned it when we got married and I moved in. So we put the house on the market, and BAM, one week later, CASH offer within 3 grand of the asking price. So we go and get pre-approved for a mortgage, going to build a new house. So far so good..

 

Then the breaks hit. My credit report was littered with fraudulet credit cards with balances. Some as high as 3k-4K. Total of around 30 grand of fraud. So I took steps. FTC fraud affidavit, police report, etc. And over a year and a half later, I got it all removed. When I discovered the fraud, my credit score was 548! Now it's 711, much much better, right?

 

So today I get this call.. From some collection agency in Indiana. Claiming I owe 3 grand on a credit card from 2000, and they were going to petition the court to collect the money. I explained, nicely, what had happned, and that it wasn't my debt, I had supporting paperwork. The man on the phone told me they were going to transfer me to the fraud department.. which turned out to be the "Im going to be an ass and agressive as hell" department. (Note: I'm aware this is normal, but bear with me.)

 

He proceeds to say that they were going to take me to court, etc. He got extra agressive when I explained what had happened and followed up with the fact thst the debt was WAY outside the statue of limitations. Florida is only 5 years, this was a 16 year old debt (That I didn't even create.) Then he got werid.. he asked me 'why are you disputing your discover card RIGHT NOW? Your a professional debtor!!' 

 

Now I'm not disputing my discover card. Not at all. I'm disputing a single charge on the card. I ordered a Wii U game for my kids off Amazon. Third party sale. They never shipped it, and didn't respond to any emails I sent them, so I disputed the charge. It was for 38.44$.

 

What was strange was that somewhere between discover and equifax it got listed that I was disputing the CARD. While I was on the phone with the highly agressive guy, I logged into here, and saw the notification that the card was listed as in dispute. I Finally got sick of trying to talk to the agressive guy and told him I wasn't liable for the 16 yhear old debt, I had paperwork to prove it and that was that. He hung up on me then. 

 

So next I contacted Discover, because I didn't dispute the card! I was told by discover that if you dispute a charge they flag the whole account as disputed, and that gets reported!?!

 

Has anyone else heard of that??

I can't answer one charge being disputed disputes the whole card but I can tell you that Zombie debt collectors are still coming after me for a 30 year old debt. I never tell them anything at all. I always tell them to send what they have to me in writing. Because of all the fraud that goes on via telephone calls no one is getting anything personal from me unless I am the one who initiated the phone call.. They generally get very rude and upset with me but I just remain firm and eventually they hang up and I don't hear anything else until my account gets sold. Funny thing is I never get the first piece of correnspondence from any of them.

Yeah.. I figured it would happen sometime.. Just was werid about the Discover thing. Anyways, I'm not going to sweat it. Just struck me as odd.

I wouldn't bother with it either. Especially, not knowing how legit they even are. Until you can get concrete evidence that shows legitimacy, I'd ignore.

Prior GF once got a call like that, someone with the same name ran up a huge hotel bill and didn't pay. Collector calling and being super aggressive. Almost had her in tears on the phone, she passed the phone to me. The guy was doing that routine about going to court. I said, great, we'd love to go to court, since we had nothing to do with this debt at all, that should be a lot of fun. When can we set a court date? Guy hung up. Never heard from again. (And nothing on her report, thankfully.)
