Judgement Asset Acceptance

I got papers saying Asset was suing 10/07 and I have been fighting since then. My attorney has been back and forth with them for 4 months trying to get validation and discovery and all the other legal things and they have not come through so now there is a hearing in 2 weeks. Is it likely I will come out ahead or  Asset? I have disputed this account on EQ and EX and seems that one has taken this account off after disputing but TU and the other hasn't. Also they bought this old citibank account in 2006 but say they have record of payment in 3/2004 but have yet to provide that proof of any payment. Went delinquent is 2003 so I believe SOL of 4 years in Texas was reached however them saying 1 payment made in all of 2004 would not put me in SOL into March this year which is after the original 10/2007 suit filing. Any help or advice as to what might happen? Anyone else with this situation?

Tx  is good state......if they say YOU made a payment    then they should be made to show a cancelled check with your name as payer!!!  they can't.

When going to court Your attorney should be able to get it dimissed!   Good luck.......Talk to your attorney about a counter suit if not too late......also if they reported a payment & you didn't make it....they are in violation (federal law)

If they have not turned over discovery   maybe they will not show up in court.

Well we got papers from our attorney today with the court date and one of the papers is for the judge to fill out and it seems they are trying to get asset to pay legal fees and some kind of compensation to us. It also says they talked to Assets lawyer twice about providing documents and both times said they would and haven't.  WE are praying it works out because we are trying to get this off the credit report to buy a house. It's the only thing affecting us right now and we can't afford this judgement then it will never happen.

Happy - Where is the Federal Law that states illegal to say one made a payment when one DID NOT?  The JDB I'm dealing with in court (my last hump) recently began the new illegal activity of reporting I made a payment back in Aug of last year and Jan of this year when in fact I've been disputing for two years - I have proof of this thanks to my mortgage credit report and I want to go after them - just want to site the accurate paragraph

They have as of Feb. this year though mysteriously disappeared from all (3) of my reports - like they were NEVER there (I'm not complaining at all), just find it ODD!
