Judgement Vacated Help

I am struggling to find a way to get a judgement vacated on my Experian report.  I was young and naive when it happened.  When I got served, I panicked and went to my landlord.  My rent was a few weeks late because of a medical emergency and they filed suit.  I told him that I didn't have the money at the time, but would have it about 2 days after the court date.  I asked him if it would be okay to pay him then.  He told me not to worry about it.  He said that if I paid them I didn't have to show up and the charges would be dropped.  Well, imagine my surprise when last year I pulled up my CR and the judgement is showing.   It's also showing as unpaid.  I received a letter of satisfaction from the Magistrate and am still working to get it to show correctly on my Experian report.

My question is, can I put in a motion to vacate since I had made payment arrangements with the suing party prior to the court date?  I am so frustrated by the entire situation.

Re: Judgement Vacated Help

Landlords pull this to 'CTA' - underhanded, but legal (it was not paid when the court heard the case and you didn't show to provide any info or justification otherwise).

The best you can probaby accomplish is getting it reporting correctly - if the landlord did business like this to start they probably won't assist in getting it removed.  Many states have an automatic ''stay' of 3-4 days if you show for L/T cases - in other words thay can't get the judgement if you pay with the stay period.

Re: Judgement Vacated Help

It really stinks.  We want to move so badly, but we will definitely have difficulty with this on our report.  Whats so frustrating is that the rent was only about 2 weeks late and we have lived here for over 5 years.  We have been good tenants, but we are now fighting an uphill battle.
