Judgement issue

I have a judgement against me for $2168. It is wage garnishment, to pay back.

My question is can they tack on extra to the judgement? The Garnishment order is for $2568.

Any ideas?

Who is they?  Your wages will be garnished for the amount that was granted by the judgment.  Sounds like the judgement is approx $300 more than the actual amount you owed, probably court costs and fees were added to the balance.

The judgement stated was for 2168.

My garnishment from the legal firm was for 2568.

Or 400 dollars more than my judgement was for, can they legally do this?

I thought they could only garnish for the amount of the judgement.

That is hard to answer.  Technically, they are not supposed to.  The judgment amount is clearly awarded by the court and the judgment will specify the amount of attorney's fees to be paid.  Legal fees assessed after the judgment are rarely awarded by the court.  The problem I see for you is that although the additional $400 was not  included in the judgment, I don't know how you can get around it without the advise of counsel, which will cost you.  So although it is probably technically  not legal to do so, you are caught between a rock and a hard place and I don't know how to tell you to fight it except to get an attorney.  This may or may not be worth it to you.

probably not worth it as the attorney fees would equal that amount, or darn near, and have to be paid up front. Just 2 1/2 weeks of extra garnishment. I am learning to enjoy Sparrow and Tennis Shoe Soup anyway. Thanks.

They can add interest until the judgment is paid so technically they can only get from your wages what the judgment is for...but I'm sure they'll up it - if you have paperwork proving your judgment, show it to your payroll and see what they say...also call the court house and ask them them, and I'd call the CA and ask what they think they are doing!  Don't just give up - to my little world $400 additional for BS is a lot of clothing or food or gas!
