June 27 is National FDCPA Violation Day

I get home and find a message from a CA collection on my Verizon Wireless CO. I received the dunning letter around 40 or so days ago and sent them within the initial 30 days a DV ketter. They signed for the DV over a week ago and all was quiet until......They called me today. They left a computerized message on my VM mentioning that they are with Pentagroup Financial and that they are a "debt collector attempting to collect a debt". Per the FDCPA, they cannot attempt debt collection until they validate it.
 
VZW says that they have an agreement with this CA that they cannot report at all. They said that about the last two CAs that tried to collect and so far so good. If only VZW would accept my PIF PFDs.

Credit Collection Services out of Mass. was hired by Geico to collect on a $30 debt back in June of last year. I found these forums in August and sent CCS a DV. To my surprise they went away. No letter, no calls, nothing.....Until, early last week (nearly 1 yr later). They called the house and left a VM for me to call back. They also mentioned that they were a debt collector in the VM. Violation? Well, I received a new dunning letter immediately after the phone call and I fired off a new DV posthaste.
 
Well, they responded to that DV today with a letter of their own saying, "This office is in receipt of a written dispute without applicable documentation....You are urged to contact a CCS service representative directly...." It also says that "this is an attempt to collect a debt.........". BTW, my DV had the name of the OC and their and CCS' acct number. NO excuses. They have all the documentation they need!
 
What's going on? Is it a full moon today?

The whole speech about "This office is in receipt of a written dispute without applicable documentation" from CA number two (pun INTENDED) seems like a buncha bull puckey, to me. Sounds as though you hit a nerve there, and they CAN'T validate and are spewing excuses to put you off.

Personally, I think it's pretty fricking pathetic that they'd fight you over a $30 collection!! What are they going to make on it? $5??!! Buncha goobers.

What have you decided about number one? Will you send them an ITS letter? It really sounds as though they're begging for one!!

Best of luck on this (and all other things!!) to you, Ilecs. Personally, I hope you kick them so hard in the proverbial cantaloupes that they sing soprano for the rest of their lives!!

The first CA (Pentagroup for VZW) is not to be feared. Yes, they violated the FDCPA, but they definitely won't report. I do want to take care of the CO, but it is up to VZW to accept the PFD. In fact, I read here recently of someone who paid VZW for a CO and their score tanked 60+ points. FICO read it as a new acct I guess. I won't do anything to Pentagroup. They'll fall out of the picture soon anyway.
 
It is the second example that I am worried about. It would be stupid for CCS to report for $30. I am thinking about sending a second DV and modified to spell out what could happen if they brush off this DV process. I might even write a copy and send it to the FTC. The ball is in my court though. I'll keep everyone updated.

I could, but I'm not the suing type. However, I'll certainly use any of this info as leverage, if I had to.
