Just got my Experian report-have 2 questions

I have 2 questions about my free Experian report I got in the mail today......

1. They spelled my last name wrong on the report! My name(s) are correct in the personal info/names section but on the front of my report my name is spelled wrong. Can I get a new report with my name spelled correctly and if so, how do I go about doing that?

2. I have an old HSBC account on my report(all 3 actually...) that was included in my BK in 4/05 but none of the reports have a date listed to which it will remain on my record for. Will it drop off in 10 years like my BK? I'm confused because everything on my reports say how long they will be listed for such as closed loans, inquiries, etc.

Name variations are really common, they usually are the cause of lenders, CCC, etc etc.. not paying attention when typing in your name onto the credit application. Therefore when an inquiry is made that name is then attached to your file. You will have to dispute that your name is wrong with Experian and once they have corrected it, then it will no longer appear on your report. This can also be caused by your creditors reporting your name incorrectly so, if you can, pay attention to your billing statements to see if they somehow misspelled your name.

As far as your HSBC account check to see if they indicate that the account was included in your BK. If not, you will want to dispute that so it can be noted on file and removed at the proper time.

1) If the error is in your "current" name, you do need to get that fixed. I don't know the exact procedure, but I do know you have to dispute in writing and include identifying info like a driver's license and/or passport copy. They should have the info on their site.

2) It will drop off in 10 from DOFD. Not because of the BK, but the bad info will only stay on for 7 and then it should convert to a clean account for the next 3 yrs.

The normal dropoff dates, as specified in section 605(a) of the FCRA, of 7 years for most delinquencies,and 10 years for BK, are not absolute.  They may still be reported forever under the exemption clause of section 605(b):

605 (b) Exempted cases. The provisions of subsection (a) of this section are not applicable

in the case of any consumer credit report to be used in connection with

(1) a credit transaction involving, or which may reasonably be expected to involve, a

principal amount of $150,000 or more;

(2) the underwriting of life insurance involving, or which may reasonably be expected

to involve, a face amount of $150,000 or more; or

(3) the employment of any individual at an annual salary which equals, or which

may reasonably be expected to equal $75,000, or more.
