Midland Credit Management Settlement

Received a claim form today regarding Hernandez V. MidlandCredit Management.  Just wondering if anyone on this broad received one too?

I see alot of people having problems with MidLand, I was just wondering who they are? CCC, CA, OC, Mortgage company, insurance company???

They are a CA. They are listed on my CR. I haven't dealt with them yet since after reading everybody's horror stories, I'm too scared too!

what kind of companies do they collect for? a veriety or just a few inparticular?

If you received a letter from Midland Credit Management, Inc. that included a "Privacy Notice," you may benefit from the class action settlement.   The case of Hernandez v. Midland Credit Management, Inc., et. at., No.04 C 7784
 
Why Did I get this notice?
We believe that the Defendants sent you a letter that contained a "Privacy Notice" stated that, beccase of an outstanding debt you have with Defendants, Defendants may or may not share certain account informtion with third parties.  You would hae received the letter containing the notice between December 3, 2003 and December 23, 2004 if you are a reside of Illinois or between January 11, 2004 and January 31, 2005 if you are a resident of Wisconsin.  You received this notice becauseyou have a right to know about a proposed settlement of a class action lawsuit brought against Midland Credit Management, Inc., MRC Receivables Corportation; and Encore Captiol Group. 
 
What is this lawsuit about?
The lawsuit claims tht the defendants violated the Fair Debt Collection Practices Act ("the Law") by sending you a collection letter that contained a "Privacy Notice" which respresnted that Defendants could discloe information to third parties, which the Law prohibts such disclosure.  Defendants deny tht their conduct violated the Law.

I think a variety of companies. For instance, mine is for First Consumer National Bank. I didn't even know about Midland until I ran my CR last month. First Consumer went bankrupt in 03 and I never heard from them.

this company nauseates me!!!!
 
i was in the process of disputing them and they had the nerve to ask me to validate the debt! i'm like whatever and then they mail me a settlement letter! i ignored it.  so now its gone off of equifax. transunion refuses to delete!!

That is the problem with disputing. When you dispute via the CRA, they have the right to ask you for information. If you refuse, the CRA can deny your dispute for failing to provide information. This is the reason DV before disputing, always.
