Need Expert help with dispute!

Hello guys,  I need your help.  I had an account with First Consumers National Bank. The account was paid in full in June 2001 and closed. My credit report is showing a ca-Midland Credit Mgmt trying to collect for this account.  I sent a dispute to all 3 cra and the ca as not mine.  Ofcourse it came back as "verified" from the cra and comments "Consumer disputes", but no response from the ca.  I then sent another dispute to all 3 cra and Experian removed it, but TU and EQ says verif.  Yes I sent the VD letter, the ca just sent me a settlement offer-wtf, it was paid 6 yrs ago.
 
Here is my question:  The orig creditor is First Cosnumer National Bank.  I did call them and they said they have no records.  I have proof -copy of cashiers check paying this account in full in June 2001.  Ofcourse the sol is over-im in CALIF.  Can I just send the ca the proof and they cant report this account any longer?

On your credit report should say the address of whoever is charging you. Give them a call and ask them about this account and talk to them. IF it is not yours, it should be easy to erase. Talk to whoever is charging you first, then try to dispute CR. They can resolve faster than you trying to dispute with the CR.

Thanks, but I did that with the oc.  They said they do not have a record especially since I closed the account and it was originally from 1998.  Should I just send the payment in full proof along with the letter that requested to close that cc -Yes I still have copies from 1995, I keep everything.  They shouldnt be able to collect anything if it was paid in full and the cc was closed, right?

Send a letter to the CA requesting complete verificaton on the account.  Explain that all account you had were PIFd wit hte OC in 2001 and you would like documentation for their collection efforts.  Advise that they have not contacted yu regarding this alledged debt and that if they cannot provide proof of the validity of the debt that they have 5 business days to remove it from your credit files or you will seek compensation UNDER the FDCPA.

Did try to call the CRA on the phone and explain to them that this is not your account and you have proof. Send to them(Copies only) of your proof, and you should make sure you send certify mail.

If you PIF 6 years ago   send them this DV letter.....all they send you was a settlement letter because they could not prove that you owed.             make all changes needed!!!

I'm sure you know, under FDCPA Section 809 (b), you are not allowed to pursue collection activity until the debt is validated. You should be made aware that in TWYLA BOATLEY, Plaintiff, vs. DIEM CORPORATION, No. CIV 03-0762 UNITED STATES DISTRICT COURT FOR THE DISTRICT OF ARIZONA, 2004, the courts ruled that reporting a collection account indeed is considered collection activity.
 
As of ( DATE that you received their letter) You have refused to validate this debt.Therfore you are in violation of FDCPA.
While I prefer not to litigate, I will use the courts as needed to enforce my rights under the FDCPA.
I look forward to an uneventful resolution of this matter, as this debt was PAID in FULL (year)
 
I request that all contact with me be in writing, and only when you can provide adequate validation of this alleged debt. To refresh your memory on what constitutes legal validation, I am giving a list of the required documentation:
  • Complete payment history, the requirement of which has been established via Spears v Brennan 745 N.E.2d 862; 2001 Ind. App. LEXIS 509 and
  • Agreement that bears the signature of the alleged debtor wherein he agreed to pay the original creditor.
  • Letter of sale or assignment from the original creditor to your company. (Agreement with your client that grants you the authority to collect on this alleged debt.) Coppola v. Arrow Financial Services, 302CV577, 2002 WL 32173704(D.Conn., Oct. 29, 2002) - Information relating to the purchase of a bad debt is not proprietary or burdensome. Debtor must phrase their request clearly to obtain: The source of a debt and the amount a bad debt buyer paid for plaintiff's debt, how amount sought was calculated, where in issue a list of reports to credit bureaus, and documents conferring authority on defendant to collect debt.
  • Intimate knowledge of the creation of the debt by you, the collection agency.
As you are already in violation, I expect all referance to this account be deleted from my credit report, as this entry and any update of such entry will be concidered another violation.

OOOPS!  I did mean DV.    I did send my proof to the cra.  TU said they couldnt accept it and will forward it to the ca?  Whatever that means. 
I will send a letter to the ca with the proof of payment and letter requesting the close of the cc account from 2001.  That should clear things up.
