PFD? Sprint

I am trying to find out the best way to go about this accountI have an account in collections with ER Solutions for $600. The OC is sprint and when i called their CSR they told me I could pay them but then i would have to notify the CA to update their records. My question since the account is with the CA should i just pay them or will it be better to pay sprint since they are willing to accept payment? and would a PD be the best way to go about it even though I know the debt is mine?

If the OC still owns the debt, you can offer to pay either.  If you pay the OC, you should not have to notify the CA of anything.  The OC must update the debt balance to $0, and notify the debt collector that their collection authority is terminated. Then the CA must also update the debt collectible to $0.  The CA account is not with you.

 

Whether to offer a PFD depends on a few other considerations.  First, is the debt still within SOL?  If it is, then a conditional PFD runs some risk of their inititation of legal action.

Second, who would you offer the PFD to?  If you get acceptance of a PFD from the debt collector, they can only delete their reporting of the CA, and cannot require any deletion of reporting done by the OC.  If you get acceptance of a PFD from the OC, what delinquecies will be covered?  The OC cant report any deletion of the CA.

If the OC has reported multiple monthly derogs and a charge-off, then if they agree to deletion of all of these, that might be the better option.  But if the OC did not do a charge-off, then I would offer PFD to the debt collector.

If  the OC is going to have you update the CA or they will update CA I would try a PFD with the CA first. Most likely once the update to the CA occurs it will change to a paid collection it will not be removed form the credit report.

It was sent to collections in 11/09 and the last date reorted is 4/10. I know the state of maryland SOL is 3 years but is that from the date sent to collections or the date the account was closed? because the account should of been closed in 07.
