Paid CA before it went onto CRs

The week before we went overseas, DD cut her foot at my parent's house and got stitches at the ER.. b/c we were moving overseas, we didn't have a forwarding addy yet & it took months for the mail to get straightened out.

The first notice we got of anything being left over after insurance was a dunning letter from CMC for the balance, a whopping $18.00. Rec'd the letter in early Mar 2006 & called/paid the same day. The CSR assured me that we had called/paid in time & it wouldn't show up on our credit reports. When I pulled our CRs in April & June of that year, the listing was not on our reports, & I still have them as proof.

Now, in 2008, it is showing on the CRs.  Is the CA allowed to report it now, if we initially paid before it ever reached the CRAs?

Re: Paid CA before it went onto CRs

i am having the same issue as you, only after they were paid 3 weeks later they reported it to the CRA's, it was paid for before they reported and I am thinking of having my old lawyer draw up a letter telling them they need to remove it from my CR cause we had an agreement that they broke.

Re: Paid CA before it went onto CRs

Because you paid a CA  without a PFD they can report.   I really do not know if the can report after receiving payment, when they had not began reporting.

Send mail to the FTC and ask them   also send copies of the old CR  that is proof that they were not reporting.

Re: Paid CA before it went onto CRs

I'm just confused b/c the CSR in 06, Miss Rose, (I keep copious notes) had told me that it wasn't reporting yet & I paid it so quickly that it wouldn't. And it didn't report on the CRs I have for all of 2006 or most of 07, didn't show up until late 07.

I've sent a letter, it came back undeliverable to the correspondence addy on their website. Not sure what to do next..

Re: Paid CA before it went onto CRs

When something is on your CR   always use the addy from there!   If that comes back undeliverable  you have something to dispute.

As to Rose....it is a he said she said!  This is why we say everything in writting.

first check the address that you sent it to    IF it is the same    and you filed a dispute & it came back verified........dispute the CRAs   send all GG  cert.paper & ........ I have a letter that needs to be altered but can go to the CRAs      let me know if you need it.

IF the addy is not the same as your CR  send a DV  to the addy on your CR

Yes, letter please. The website addy was the same as the CR addy. Luckily I kept the envelope...

Re: Paid CA before it went onto CRs

Reword this.  Do not put anything in it about talking to ROSE!  The CRA doesn't care.   CMRRR
the undeliverable is whats important here.

RE: Account #_________/Original Creditor’s Name

Dear CRA:

This is a request for deletion of a disputed item. I have attempted to have this allleged debt
verified by the alleged creditor and collection agency to no avail. I am respectfully requesting that
"Collection Agency" do what is legally mandated by the FCRA and FDCPA, and delete the account listing.

Name of Creditor/Agency, Account #_________

On XX XX 08, "Collection Agency" received a demand for validation from me. Attached is a copy of that letter along with the U.S. Post Office return receipt showing they did indeed receive the request.

As of today, XX XX 2008, they have failed to provide any proof or respond in any way.
On XX XX 08, I sent a second letter. Again, I have received no response. Attached is a copy of the
letter and the U.S. Post Office showing they did receive that letter.

The FDCPA states they must cease collection activity until they have produced verification of the
alleged debt if so requested. As per the FTC, this includes reporting to the credit bureaus, which
they obviously have done illegally. It is quite evident that no such proof of this alleged debt exists
or they would have provided it in the previous X months since it was requested.

Also, when an alleged debt is disputed, a notation must be entered on the debtors report showing the
item as in dispute. Again, this was not done. Another violation of the FDCPA. (DELETE THIS PARAGRAPH IF IT DOES NOT APPLY!!)

As per the FCRA, if no proof of debt exists, it may not be reported to the credit reporting bureaus.
The FCRA also states that the credit reporting agencies must accept written proof from the debtor.
Therefore, I am not asking for an investigation to be done, I am requesting that the entry be deleted
in its entirety as there is no proof of its existence as evidenced by my attached documented proof.
Sincerely,

Your Name
