Please help! Dispute Issue making mortgage impossible!

Hello Everyone,

I am new here and I am hoping to get some help if possible.  Recently, I decided to try and purchase a home.  My credit score is around 675 which is “ok” from what the bank tells me.  When the bank runs what they call a “Cert” the cert returns disputes on my credit file.  The disputes only appear on the Equifax Report as they pull a tri-bureau report, however if one report shows disputes the loan cannot go through to underwriting.

I have NOT disputed anything on my reports in over a year.  It was my understanding that disputes closed after 30 days.  Apparently, the comments on two accounts read “consumer disagrees with dispute results – reinvestigation in progress”.  I never agreed or disagreed.  After submitting these disputes over a year ago, I never was given an option to agree or disagree.

Well the issue is now that I am trying to get these comments removed, as I am not disputing the accounts as they are closed and paid in full, Equifax cannot seem to get that right.  I call their customer service center in India, and get someone on the phone that just reads a script and does not help at all.  They claim they have to resubmit a dispute and that will take 30-45 days etc.  I DO NOT want to dispute anything I keep telling them.  They are telling me they have no authority to remove the dispute comments, even after I tell them I am NOT disputing anything.  The person on the phone in India claims they cannot transfer me to an American call center and they do not have a supervisor I can talk to.  I just want the darn disputes off of my report as I am not disputing anything!

Transunion and Experian removed the disputes in one call.  Equifax is the only bureau I am having an issue with.  Does anyone know how I can get this taken care of? It is really causing a mess in my mortgage process and making it impossible for my family to get a new home.

Any advice will be appreciated.  Thank you!

Where on your report does the word "Didpute" show up?

Is it in the Comment section?

Hello,

Yes it is the narrative comments section of the account.

Thanks.

Re: Please help! Dispute Issue making mortgage impossible!

Welcome to the forums!

During a dispute, a comment will be placed in the comments section of that TL and the CRA has 30-45 days to wrap up the dispute. When the dispute period ends, the CRA can then decide to update the TL based on info provided by that creditor, delete it, or verify it. The CRA won't ask you if you agree with the results. They'll take the action and if you disagree then you'd take it up with that creditor. After the dispute concludes, a dispute comment will remain, sometimes, but it should remain in the passive tense (e.g. "Accounts disputed - customer disagrees" or something similar like that).

Sometimes, calling or writing the creditor can lead to a creditor to report the TL as being in dispute. I kept sending GWs to one and they always updated it for 3-6 months at a time as "Dispute reported by subscriber" or something like that. OP, did you call or write that creditor recently?

Have you talked to your LO about this? While there's a no-dispute policy with FHA and others, some lenders tend to overlook it. Mine did. I was forthcoming about the dispute (well, non-dispute) and they didn't say anything about it. Also, your lender might be able to do a rapid rescore if pressed for time and sometimes that can clear up a dispute comment. And maybe the item that is in dispute within that TL is benign enough to not cause any trouble.

Here is an older thread with some information from one of our resident mortgage experts that might be of some help to you: How To Remove An Account In Dispute For Mortgage.

I used the numbers from Shanes thread and got dispute comments removed from the Ex report within hours.
