Progress..... I think?

Got back 2 of the 4 CMRRR's today But unfortunatley they wwere sent to the wrong people, I sent them to the OC instead of the CA which one is not listed with a CA, so now we wait some more.

I am not waiting for answers from them in 30 days since OC's do not have to answer DV's

Do you think I should send out DV's to the CA that do have some accounts listed on my CR even though I sent some to the OC already, or should I wait and see what happens?

I am thinking just maybe by some chance a new hire will get them and not know what to do with and make my day.  (Hey I can dream can't I?)

Re: Progress..... I think?

Here's what worked for my daughter in getting bogus CA listings deleted from her credit reports.

When the CA is already listed on the credit report, send a DV CMRR to the CA.

Why?  Although the CA does not have to respond to a DV request that is already on your credit file,  you want to have proof that the debt has been disputed so that hopefully, you can force the CA to validate the debt with the CRA in the next step.

Once you receive the green card back, send a request for verification to the CRA.  If the CA verifies with the CRA, the CA MUST report that the account as disputed.

Once you have verification from the CRA that the CA verified and/or updated the informtion in your credit file, send a second DV request to the CA.  FDCPA requires that all collection activity cease on a disputed debt until validation is provided.  By verifying with the CRA, after receipt of the first DV, the CA resumed collection activity and must therefore provide validation, otherwise they are in violation of FDCPA.

The catch22 is that if the CA doesn't verify with the CRA, the CRA must delete.  If the CA does verify, they must provide the validation.
